Global Diligence LLP: international law and human rights compliance www.globaldiligence.com Richard J Rogers Founding Partner Global Diligence LLP [email protected] London, UK 8 December 2022 RE: STATUS OF MR SWAMI ARUNACHALAM SRI NITHYANANDA REGARDING INTERPOL To Whom it may concern, This letter outlines and clarifies the current legal status of Mr SWAMI ARUNACHALAM Sri Nithyananda with respect to INTERPOL notices. On 22 November 2022, the INTERPOL’s Office of Legal Affairs of the General Secretariat issued a document (Ref: LA/88732-1587) certifying that “Mr SWAMI ARUNACHALAM Sri Nithyananda […] is not subject to an INTERPOL Notice or diffusion.” The above certificate accompanied a fully reasoned decision of the Commission for the Control of INTERPOL’s files (CCF), dated 13 October 2022. The CCF Decision rejected an application for revision by the Indian Authorities and confirmed that the Indian request for a Red Notice violated INTERPOL’s Constitution (Article 2) as it was not compatible with the spirit of the Universal Declaration of Human Rights. The CCF confirmed that Mr SWAMI ARUNACHALAM Sri Nithyananda’s ‘protected status’ protected him against refoulement (forced return) to India ‘where his life or freedom would be threatened on account of his race, religion, nationality [...]. The principle of non-refoulement is a fundamental right guaranteed by the Geneva Convention of 1951 related to the Protection of Refugees, the American Convention on Human Rights, the UN Convention Against Torture, and customary international law. The CCF thereby reaffirmed its previous decision, dated 26 February 2021, rejecting India’s requests for INTERPOL Blue and Red Notices. Therefore, any statement suggesting that Mr SWAMI ARUNACHALAM Sri Nithyananda is currently subject to an INTERPOL (Red or Blue) Notice or Diffusion is incorrect. Any public statement to this effect is potentially defamatory and may attract legal action and damages. ---------------------- Richard J Rogers Partner, Global Diligence LLP
