Introduction

2446 / 2500 words

This submission by Kailash Union responds to the request of the Human Rights Council in Resolution 57/28, which called upon the UN High Commissioner for Human Rights to conduct a global analytical study on the implementation of a human rights-based approach (HRBA) in the Kunming-Montreal Global Biodiversity Framework (GBF).

Consistent with Section C of the GBF and the outcomes of CBD COP16, this report provides examples, data, and analysis on the United States of KAILASA's integration of human rights in biodiversity strategies, measures to protect traditional knowledge, monitoring mechanisms, identified challenges, and recommendations.

KAILASA recognizes that biodiversity loss disproportionately impacts Indigenous Peoples, local communities, and vulnerable groups.

Our approach to GBF implementation prioritizes the respect, protection, and fulfillment of human rights – particularly the rights to participation, Free, Prior and Informed Consent (FPIC), and equitable benefit-sharing.

Structured around the OHCHR’s key questions, this report details:

(a) Measures securing rights in GBF implementation

(b) Positive outcomes of HRBA adoption

(c) Human rights monitoring mechanisms

(d) Identified challenges

(e) Integration of rights into national frameworks

(f) Alignment with CBD COP16 outcomes

(g) Forward-looking recommendations.

Biodiversity in Hinduism

Hindu cosmology views Earth as a living Bhūmi Devī (Mother Earth) and all life as sacred.

Hindu scriptures like the Varaha Purana exhort tree-planting as a sacred duty and forbid cutting holy trees, while the Atharva Veda calls Earth our mother and humanity her children.

This reverence informs Hindu environmental ethics: ahimsa (non-violence) extends compassion to all beings, and every creature is believed to carry an ātmā (soul).

Such teachings have long fostered sustainable practices—organic farming, cow-based agriculture, sacred groves, and ritual respect for rivers and forests—that align with modern conservation goals.

For example, the Atharva Veda’s “Bhūmi Sūktam” hymn venerates the Earth and inspired traditional soil and water care; similarly, Panchagavya (cow manure-based biofertilizer) exemplifies Hindu Vedic organic farming.

By invoking these truths and Hindu sciences, the United States of KAILASA, the ancient enlightened Sanatana Hindu Indigenous civilizational nation, revives these nature-centric values as the basis of its biodiversity action.

KAILASA’s Nature-Based Solutions and Practices

The initiatives of the United States of KAILASA, revived by The Supreme Pontiff of Hinduism (SPH) Bhagavan Nithyananda Paramashivam put Hindu ecological principles into practice. For instance:

- Organic, Cow-Centric Agriculture: KAILASA communities cultivate the land without chemicals, using Panchagavya (cow based products, made as per Hindu scientific formulas) compost and biodynamic methods rooted in Vṛkṣha Āyurveda¹.

Consistent with these ancient Hindu texts, KAILASA’s farming eliminates synthetic inputs, builds soil fertility, and honors cows as sacred providers.

By promoting vegetarianism (ahimsa diet) at scale, KAILASA’s approach aligns with scientific findings that plant-based diets ease land use and climate pressure.

- Water, Herbal and Livestock Stewardship: Drawing on ancient Hindu Vasiṣṭha, Brihat Saṃhitā and Manusmṛti knowledge, KAILASA revives traditional water-harvesting (step-wells, earthen dams) and herbal conservation.

Local sacred tanks and ponds are managed with reverence, reflecting the Vedas’ teaching that rivers and wells deserve ritual care.

Cow protection (gośrī) is constitutionally mandated in KAILASA, linking animal husbandry to ecology.

¹ Vṛkṣha Āyurveda, an ancient plant science, prescribes crop rotation, organic manure and pest control to sustain soil and air quality.

- Ahimsa and Protection of All Life: KAILASA’s environmental laws protect the rights of all beings (sarva-bhūtahita), strictly forbidding the killing of animals, insects, or any living beings.

This principle of non-violence (ahimsa) is not limited to human interactions but extends to the entire web of life.

- Ethical Governance & Education: KAILASA’s laws embed Dharma Śāstra duties: environmental protection is a constitutional mandate for all citizens.

Its “Nataraja Sabha” (part of KAILASA’s Hindu Parliament) includes environmental ministers from around the world advocating Right to Nature.

KAILASA’s education (Nithyananda Gurukul, Jñānalaya²) teaches millions worldwide (over 20 million youth) that ecological care is a spiritual responsibility.

Such cultural empowerment reflects research that knowledge-sharing networks and education boost conservation outcomes.

Global Indigenous Leadership through UAN - Measures securing rights in GBF implementation

KAILASA is a founding member of the United Ancient Indigenous Enlightened Nations (UAN) — an inter-governmental body uniting Indigenous nations and diasporas across continents to advance global peace and ecological harmony.

² Hindu library

The UAN serves as a beacon of collective Indigenous wisdom and solidarity, built upon shared values of sustainable living, reverence for nature, and ancestral governance.

As modern society faces rising ecological crises, violence, and social inequities, the UAN affirms that Indigenous Peoples hold vital solutions rooted in harmony with nature.

The body includes members from African, Andean, American, European, Caribbean, Oceanic, and Asian Indigenous traditions.

The UAN’s focus areas include:

- Cultural Preservation & Heritage: Safeguarding and revitalizing Indigenous languages, arts, oral histories, and spiritual sciences.

- Leadership & Governance: Empowering Indigenous leadership and community-led governance models.

- Environmental Stewardship: Reviving regenerative practices and climate-resilient land management rooted in ancient knowledge.

- Health & Wellbeing: Integrating Indigenous medicine and spiritual healing with holistic wellness.

- Youth Empowerment & Education: Fostering skills and consciousness-based leadership in future generations.

- Economic Resilience: Promoting ethical, Indigenous-owned enterprises and circular economies.

- Intercultural Dialogue & Advocacy: Creating representation in global policy spaces and building bridges with non-Indigenous allies.

- Technology & Innovation: Leveraging AI and digital tools to document and share Indigenous sciences.

Through UAN, KAILASA extends its indigenous ecological frameworks into global collaboration, enabling spiritual and environmental leaders from diverse traditions to co-create solutions for biodiversity, climate, and peace.

Alignment with Human Rights and the GBF

The GBF explicitly recognizes indigenous and traditional knowledge as central.

Section C of the GBF affirms that indigenous peoples and local communities are “custodians of biodiversity” whose rights, knowledge and values must be “respected, documented and preserved with their free, prior and informed consent”.

It acknowledges that diverse value systems (like seeing Earth as sacred) are integral to success.

Similarly, the Convention on Biological Diversity (CBD) encourages Parties to honor Article 8(j), preserving Indigenous knowledge in conservation.

The practices of KAILASA, an indigenous nation, are a concrete application of this mandate, and embed traditional knowledge documentation into site management.

Research affirms this approach: land managed by Indigenous peoples retains more biodiversity than other areas.

For example, UNDP notes that Indigenous lands contain much of the world’s biodiversity and carbon, and are often in better ecological health.

A human-rights-based approach to biodiversity (HRBA) yields better outcomes for the people and planet.

KAILASA’s model follows this: by giving communities ownership of sacred sites and farming practices, it reinforces rights to land, food and culture while conserving ecosystems.

Such community-led restoration increases plant diversity, stabilizes soils and watersheds, and improves livelihoods.

⁴Reports on Jagadish "Jaggi" Vasudev’s (Satguru) attempt to kill SPH https://www.gurumag.com/inside-sadhgurus-cult-empire/, https://www.youtube.com/live/uLFpZBpGj1A

On 2 March 2010, a deep fake video was released by Hindumisic forces through their media houses, such as Sun TV and Nakkheeran to incite hatred and persecution on SPH ⁵ ⁶ ⁷.

This event marked the onset of nearly two decades of relentless persecution targeting SPH, The Ecclesiastical Head of two billion Hindus, and KAILASA⁸.

The UN should take strong measures against such media houses and address the ongoing persecution.

⁵ A morphed defamatory video of the actress Ranjitha with SPH was spread virally over the print and electronic media by the deep state controlled Sun TV. The video was analyzed and proven to be false on almost 60 technical points by 4 independent forensic experts including from the FBI, Canada, etc. In 2012 the Chief Operations Officer of Sun TV gave a television interview accepting that the channel manufactured fake news to target SPH (18 Dec 2012 - Jaya TV - Hansraj Saxena’s Statement - Jaya TV(https://shrikailasa.github.io/persecution_evidences/Confession_of_Sun_TV_COO_Hansraj_Saxena_o n_national_television.mp4This video was removed in hours after it was telecast; the AIAT legal archives have downloaded the same for evidence and records. Later in 2014, he reiterated this statement in an affidavit to a US court (US District Court, Central District of California, Case 5:13-cv-00393-VAP (SPx), document 156-3, 3 Nov 2014, Declaration of Dharmaraja Hansraj Saxena. https://shrikailasa.github.io/persecution_evidences/Affidavit_of_Dharmaraja_Hansraj_Saxena.pdf). Although the courts ordered in her favor restraining the misinformation (W.P. 8619/2011, WP 7767/2010, 14/527/10-11-PCI, 2 Sept 2013 BCCC Order, NBSA #32/2014, etc.) and telecast of fabricated deep-fake videos, the media kept pushing the implementation of the order to various quasi-legal institutions (self-regulatory bodies run by the media itself). Finally, the media self-regulatory quasi-legal body, the NBSA ordered its member channels to remove fabricated defamatory videos from their websites (News Broadcasting Standards Authority Order No. 32 (2014) dated 27 Aug 2014, found Zee TV and Aaj Tak in contempt of court), and were ordered to apologize and also delete all similar videos from their websites also (refer point - 6 of the same order). http://www.nbanewdelhi.com/assets/uploads/pdf/2014_12_ORDER_NO_32_DT 27_8_14.pdf ). None of the media houses complied with the order and kept reuploading, re-telecasting the same footage, and continue the misinformation propaganda to date.

India, 2019, Extradition Abuse - Despite intense pressure from the deep state, the Karnataka Police refused to falsely declare SPH as an absconder, citing no legal basis and warning that courts would dismiss such a baseless claim.

Undeterred, the deep state then pushed the Gujarat Police to pursue the matter, but the court demanded an Interpol report, which revealed that Interpol had rejected the request as politically motivated and incompatible with human rights principles.

The court subsequently rebuked the Gujarat Police, exposing the malicious intent. This reaffirmed SPH’s status as a protected religious leader and highlighted the abuse of legal processes against him.

Legal & Human Rights Violations

[]

Over 100³⁰ racist, anti-indigenous media outlets³¹ in Bolivia, India, USA and others accused KAILASA of exploiting indigenous lands by coercing Indigenous nations into signing agreements, despite legally ratified, notarized and protocolized agreements, and obtaining written community consent prior to the execution of any given agreement,³² in line with Bolivia’s constitutional right to self-determination.³³

³⁰ https://drive.google.com/drive/u/0/folders/1rdmintiugyCBdqG3BfQ3G8fzNc3Js8Lw

³¹ Such as El Deber and Ana Bolivia as well as India outlets like Times Now, TV9, Zee Tamil news, News Minute and Republic World

³² Despite facing persecution fueled by Hinduphobic rhetoric, racial discrimination, and anti-indigenous agendas propagated by certain political and media factions, Bolivia's indigenous communities remain steadfast in their alliance with KAILASA, continuing to uphold their partnership with resolute solidarity.

³³ Articles 30.2:

In the framework of the unity of the State, and in accordance with this Constitution, the nations and rural native indigenous peoples enjoy the following rights:

- To self-determination and territoriality.

- To the collective ownership of land and territories.

- To the practice of their political, juridical and economic systems in accord with their world view.

They launched hate speech once again by falsely labeling KAILASA as a “fictional nation” and defaming SPH as a “self-proclaimed god-man.

KAILASA’s Struggle to Protect Temple Lands and Wildlife Sanctuaries in Rajapalayam and Seithur, India

[]

34

The temple ecosystem serves as the gateway to this realization.

KAILASA, under the leadership of SPH, is engaged in a critical effort to protect sacred temple lands in Rajapalayam and Seithur, India, from commercial exploitation.

These lands, designated as sanctuaries for elephants, agricultural zones, and spiritual reserves, embody the Hindu principle of Ahimsa (non-violence) and Dharma-based ecological balance.

However, they face imminent threat from proposed multiplex developments by private entities.

- To autonomous indigenous territorial management, and to the exclusive use and exploitation of renewable natural resources existing in their territory without prejudice to the legitimate rights acquired by third parties.

Article 289: Rural native indigenous autonomy consists in self-government as an exercise of free determination of the nations and rural native indigenous peoples, the population of which shares territory, culture, history, languages, and their own juridical, political, social and economic organization or institutions.

³⁴ https://www.youtube.com/shorts/B7nGniQhVWQ

Despite recent incidents of elephants breaking boundaries—a natural behavior in their ancestral habitat—KAILASA maintains its commitment: “This is their land. Let them roam freely.”

The detailed video evidences of the same captured by both Kailasa and the press are at (305) Persecution of KAILASA Rajapalayam and Seithur - YouTube.

[Court Stay Order on the Illegal Order of Sub Collector] https://drive.google.com/file/d/1xDhmyleKuP2wjrzvVs9lxKgvn1X8WAkG/view?usp=drive_link

⁴⁵ Upon subsequent discovery of the order, it became evident that the mandatory procedural safeguards under Section 164 of the BNSS were disregarded. The provision explicitly requires an Executive Magistrate to:

1. Issue a reasoned written order specifying the grounds for action; and

2. Provide formal notice to affected parties, ensuring an opportunity to be heard.

The failure to adhere to these statutory obligations resulted in a denial of the Trust’s right to a fair hearing, rendering the order procedurally defective. This omission suggests either administrative negligence or a deliberate circumvention of due process, warranting judicial scrutiny.

The circumstances indicate a breach of fundamental legal principles, necessitating appropriate remedial action to rectify the denial of justice.

9 June 2012, Bengaluru, Chief Minister of Karnataka State - D V Sadananda Gowda, publicly announced⁴⁸ the State’s illegal⁴⁹ takeover of the privately owned temple monastery and the illegal arrest of SPH.50 51

⁴⁸The Chief Minister of the state of Karnataka came on television saying he would - ‘arrest The SPH in 2 days, close the monastery, teach The SPH a lesson’.

⁴⁹ Shankarappa who is a legal expert gave his legal opinion on the matter as: “The chief minister's order is illegal, and he acted in haste.

The political head of the state has no power to order anyone's arrest as it is an infringement of an individual's rights.

It is unfortunate.. he seems to have surrendered himself to some vested interests. If anyone has a grievance, he should file a complaint.

Or police can take up a suo motu case and investigate what occurred in the ashram. Media reports cannot be the basis for any order”.

24 May 1994, a year before her death, Mata Vibhutananda Puri, coronated SPH as Her successor to the spiritual seat of Arunachala Sarvajnapeetham⁵⁴, Tiruvannamalai, by Guru Parampara (Guru lineage) from Isakki Swamigal, and gave the title “Brahmasukhi” through a formal initiation⁵⁵.

She built and gifted SPH a simple monastery in Pavazhakundru.⁵⁶

⁵⁶ Pavazhakundru is a sacred hillock in Tiruvannamalai where Devi Parashakti (primordial Hindu Mother Goddess) had Her enlightenment experience during one of Her incarnations on the planet earth. Pavalakundru is also where SPH had His first enlightenment experience upon the Paramashiva Shila, the

sacred rock, which is worshipped today as a Deity.

Though SPH is the legal owner of the land⁵⁷, Tamil Nadu State Government has repeatedly prevented the monks and nuns of SPH from performing worship to the sacred hill.

Monks were forcibly evacuated by authorities beaten, tied and raped in front of the State Police by State-groomed Hindumesic forces of the DMK and CPI(M).

The Paramashiva Shila was vandalized and desecrated with footwear.

Indigenous Temple Land Grab - KAILASA Madurai Aadheenam

On 27 April 2012, SPH was coronated as the 293rd Pontiff of the Madurai Aadheenam, the world’s most ancient Shaivaite monastery⁵⁸.

This was extremely intolerable for the Hindumisic terrorists, who made more than eight vexatious litigations to dethrone SPH⁵⁹.

In response, they conspired against SPH, launching numerous assassination attempts⁶⁰ and initiating a prolonged campaign of legal harassment—a lawfare that continues to this day.

SPH was unconstitutionally and illegally prohibited by the High Court of Madras from entering Madurai Aadheenam of which He is the 293rd successor.⁶¹

Though the order itself violates the constitution, Justice Mahadevan upheld the decision and even threatened SPH that he would order the arrest of SPH if SPH did not resign from His responsibility as the successor.⁶²

⁶⁰ - 29 May 2012 - A mob of 100 anti-Hindu atheistic militants, who opposed the appointment of the SPH as the 293rd Pontiff of Madurai Aadheenam, came to mob lynch the SPH when he was at his Kanjanur Agneeshwara temple residence.

- The next day on 30 May 2012, the SPH was leaving the city of Kanjanur when again a mob of anti-Hindu atheistic militants attacked, disciples of the SPH were assaulted^(#) in front of the police.

- 2 February 2018, when an explosive arson attack was carried out against SPH at the Madurai Meenakshi Temple. The blast caused significant damage, destroying a section of the temple and leading to the collapse of a 600-foot stretch of stone from the 3,000-year-old sacred structure.

⁶² As per the Constitution of India, a person is to be treated as innocent until proven guilty, and no one has the right to pass judgment on such a person. SPH has never been implicated in any crime. Yet against the very constitution of the country, He has repeatedly been treated in a prejudicial manner as assumed guilty. Justice Mahadevan went on to pass an order blatantly violating the fundamental rights of SPH and against the very tenets of natural law and justice and on record said, "Who permitted you to record court proceedings? To whom were you sending-message about the proceeding? Don't think that this court is a playground. I will see that your ashram is vanished. Hundreds of complaints are pending against the ashram."

Right from 2012, SPH was stopped from performing the essential religious rituals of the Arulmigu Meenakshi Sundareshwarar Temple, such as the Kumbha Abhishekham³⁵⁹, which happens only once in several years and is one of the primary responsibilities of the Gurumahasannidhanam, who is the incarnation of Paramashiva, to directly supervise and perform. https://shrikailasa.github.io/persecution_evidences/Order_to_Crp.(PD)(MD)_818-of-2018_and_CMP(MD)

Indigenous Temple Land Grab - The Four Mutts

In 2014, SPH was formally appointed⁶³ as Pontiff, the spiritual and legal head (Madadhipati) by the previous Pontiff, Swami Sri Atmananda, through four official nomination deeds.⁶⁴

Hindumesic state backed elements with vested interests—who had previously been benefiting from the properties owned by the mutts—conspired to remove SPH from his rightful position as Madadhipati.

Their objective was to seize control and misuse the land, valuable assets and heritage of these historic religious institutions.

To achieve this, they actively illegally obstructed the disciples of SPH from taking over the administration of the mutts.

As part of their efforts, they initiated false legal action seeking an order to prohibit SPH and His representatives from entering and managing the monastery premises.⁶⁵

⁶⁷ Article 26 of the Constitution grants religious denominations the autonomy to:

- Establish and maintain institutions for religious and charitable purposes.

- Manage their own affairs in matters of religion.

- Own and acquire movable and immovable property.

- Administer such property in accordance with law.

Judicial Precedents on HRCE Act & Mutts:

- The Supreme Court and High Courts have held in multiple cases that mutts enjoy protection under Article 26 and are not automatically subject to state control under the HRCE Act unless specific conditions are met.

Case Law:

- Commissioner, HRCE v. Sri Lakshmindra Thirtha Swamiar (1954) (Shirur Mutt Case) – The SC ruled that religious denominations (including mutts) have the right to manage their internal affairs without state interference.

- S.P. Mittal v. Union of India (1983) – Reiterated that religious institutions have autonomy under Article 26.

- Dr. Subramanian Swamy v. State of Tamil Nadu (2014) – The Madras HC observed that mutts, being religious institutions, enjoy protection under Article 26, and state intervention must be limited.

The Systemic Persecution & Obstruction of Hindu Religious Celebration in The Gambia

In February-March 2025, a coordinated campaign targeted the Kumbh Mela, the largest peace congregation on earth⁶⁹, in The Gambia organized by a female monk of the Sovereign Order of KAILASA’s Nithyananda.

The deep state of India, using local proxies, spread disinformation, hate speech, and threats to suppress it, reflecting a wider trend against indigenous Hindu groups.

Persecution of KAILASA’s Nithyananda Gurukul⁷¹

Through His Gurukul students, SPH has demonstrated the considerable impact that elevated states of consciousness can bring.

The initiated Gurukul children have showcased remarkable abilities such as causing rose plants to drop their thorns⁷² by radiating intense love, oneness and a sense of security.

With the conscious intention to manifest rain as a Sankalpa (conscious declaration), the Gurukul children have commanded rain by performing the Homa (sacred fire ritual).

KAILASA has dedicated over 624,150 minutes⁷³ to conduct Hindu peace services, meticulously reviving the time-honored sciences of Hindu enlightenment.

On 5th June 2017, World Environment Day, the world witnessed the historic happening on the planet - SPH Himself manifested rain in 108 places across the globe⁷⁴, bringing tremendous healing to the environment.

The destruction of KAILASA’s Gurukul ecosystem was largely due to the fact that every child was being taught, as part of the core curriculum, the age-old indigenous sciences of environmental conservation and preservation.

Though Indian law provides for traditional education for Hindus in traditional schools called Vedic Pathashalas, the deep state elements have been successful in stopping Indigenous Hindu education or making it difficult

⁷¹ The Ancient Enlightened Hindu Gurukul system of education is based on the transmission of knowledge from Guru to disciple and tailored to the unique traits, inclinations and DNA of the disciple.

The Gurukul is the space where children are taught to identify their conscious aspirations and guided to achieve that rather than today’s system of rote learning and memorization, ‘uniformized’ across the spectrum from teacher to students.

⁷⁵ In July 2013, a fanatic clergy named Father Edward Thomas and deep state extremist B. Shivaraj Gowda, in accomplice with rogue elements of the state government executed a vexatious investigation on the Nithyananda Gurukul in Karnataka to harass the students and their parents and force a shutdown (http://archive.indianexpress.com/news/nithyananda-ashram-in-child-rights-row/1174496/ ). On 24 July 2013, the Karnataka State Child Rights commission raided the Gurukul and bullied the children. The parents of the children were not present, and no prior permission of the parents or the Gurukul (the Ādi Śaiva Vēḷāḷar school) was ever sought by the Karnataka State Child Rights Commission. The Karnataka State Child Rights commission came without any permission from Court or notice. The state authorities could not find anything wrong, but the Karnataka State Child Rights Commission and Department of Women and Children and other government agencies made multiple visits and harassed the children, intimidating them to leave the school. The Karnataka State Child Rights commission authorities asked children inappropriate and humiliating questions, such as:

a. They mocked their traditional dressing, demanding them to wear jeans and pants instead of traditional saffron robes.

b. They mocked the organic vegetarian traditional food that the children were eating.

c. The children were sitting on the ground and eating, as that is the ancient Ādi Śaiva Vēḷāḷar tradition, the board questioned that and many simple ancient traditional ancient lifestyle aspects.

d. They intimidated the children by claiming that they had no future in the Nithyananda Gurukul and that they should leave. Children reported to the Principal of being bullied and harassed by the officers.

e. The testimonials of the children of the harassment by the various government departments who made several unauthorized visits have been documented by the children and parents.

⁷⁶ A vexatious police complaint was filed by the CWC team led by Father Edward Thomas against the legal counsel of the indigenous school and parents Ragasudha Vasundhara Shivanna on 25 July 2013, against which the Karnataka state police registered a formal complaint FIR 340/2013 Bidadi PS on the date 19 September 2013 under section IPC 186.

⁸⁰ 16 Oct 2013, in a deep state controlled newspaper, Indian Express published (16 Oct 2013, The Indian Express, "Nithyananda ashram produces 88 students before child welfare panel" (http://archive.indianexpress.com/news/nithyananda-ashram-produces-88-students-before-child-welfare-panel/11832 44/) that the Karnataka State CWC Officer, Shivalingaiah said, “We found the children brilliant”. However, the Officer falsely claimed, “But they are not receiving formal education. They (the ashram) do not have accreditation from any government agency, they do not follow the law of the land and do not have an authentic syllabus for the children.” Several other deep state controlled newspapers such as Deccan Herald also spread misinformation and justified the legal terrorism by falsely accusing the traditional school of child rights violations. The claims of the Karnataka State CWC were malicious, vindictive, and counterfactual; as per Right To Education (R.T.E.) Act Section-1(5) - Vedic Pathashalas (Indigenous, religious, traditional Hindu schools) are exempt from the purview of the RTE Act, so the CWC had no jurisdiction or rights in interfering with the school.

On 8 Feb 2014, the Officers from the Department of Women and children announced their plans on television (http://shrikailasa.github.io/persecution_evidences/gurukul/DWC_officer_tv_announced_plans_08-Feb-2014.png) to shut down the Nithyananda Gurukul. On multiple occasions - (1) order dated 29 Jan 2014, passed by the Director (2) order dated 11 Feb 2014 passed by the Commissioner - The State Public Education Department, rejected the application of the indigenous community school without providing any hearing which is contrary to the provisions of law as per Karnataka Education Act. On 11 Feb 2014, this was pointed out by the community and submitted in their Amended Writ Petition WP 8805/2013 WP-8830-873/2014 (http://shrikailasa.github.io/persecution_evidences/gurukul/Amended_Writ_Petition_WP_8805-2013_END_RED_WP- 8830-873-2014.png). On 13 Feb 2014, the State Government sent a notice through the State Police to the Nithyananda Gurukul to shut it down and within a timeline of 7 days from receiving the notice to send the children of the Gurukul to a nearby Government school or a private school (http://shrikailasa.github.io/persecution_evidences/gurukul/Karnataka_State_Police_Notice_Gurukul_13-Feb-2014.pn g).

On 14 Feb 2014, the State Minister of education publicly re-iterated the lies spread earlier through the media and ordered the shutdown of the Gurukul arbitrarily without any verification of facts and due process (http://shrikailasa.github.io/persecution_evidences/gurukul/Karnataka_State_minister_education_gurukul_shutdown_ 14-Feb-2014.png,

https://www.thehindu.com/news/national/karnataka/teacherfriendly-transfers-in-the-offing-ratnakar/article5685916.ec). 17 Feb 2014, Nithyananda Gurukul appealed in the High Court for a stay order against the persecution of the gurukul including denigrating and ridiculing the spiritual names (http://shrikailasa.github.io/persecution_evidences/gurukul/Writ_Petition_WP_8805-2013_END_RED_WP-8830-873- Edexcel-IGCSE-2014-p4.png) given to students as per native Hindu Vedic tradition and with the consent of parents. (http://shrikailasa.github.io/persecution_evidences/gurukul/Karnataka_HC_Stay_Order_Gurukul_17-Feb-2014-p1.pn); and it was granted by the High Court (http://shrikailasa.github.io/persecution_evidences/gurukul/Karnataka_HC_Stay_Order_Gurukul_17-Feb-2014-p2.pn). Even after the stay order the officers of the Department of Women and Children did not stop harassing and made another visit and interrogated the children in the same illegal, cruel, and degrading manner (http://shrikailasa.github.io/persecution_evidences/gurukul/DoWC_harassment_visit_17-Sep-2014.png).

19 Nov 2014, further, the school kept knocking on every door for justice, and approached and submitted an appeal to the Minister for Women & Children, the Chief Minister, the Governor, State, and National Human Rights Commission (http://shrikailasa.github.io/persecution_evidences/gurukul/gurukul_justice_appeal_goi_MoWC_nc_19-Nov-2014.png. On 12 Mar 2019, the High Court passed an order quashing the illegal notice and proceeding of the Education Department. This did not remedy the situation. Even after March 2019, the Nithyananda Gurukul continued the struggle to run traditional and indigenous traditional schools for the AIAT children in the face of hate speech and attacks against the Gurukul.

Overview of KAILASA’s Biodiversity Policies and Positive outcomes of HRBA adoption

KAILASA’s International humanitarian agencies⁸⁶ operate as a worldwide movement in about 196 countries around the globe empowering communities through several green initiatives to ensure a safe, clean, healthy and sustainable environment; and to educate and implement these techniques worldwide.

⁸¹ The officials in plain clothes, without properly identifying themselves, barged into the campus of the school past midnight, woke up the minor girl and boy students, and questioned them with intimidation and illegal persuasion tactics.

⁸² On 28 Dec 2019, the Monastery buildings were razed to the ground without any formal notification or right to respond. The owner of the building was illegally arrested, and other schools administered by her were closed down without due process in the middle of the school year.

⁸³ In 2019 AIAT members from the USA submitted a report documenting these human rights violations against the SPH and the AIAT community in India. On 6 December 2019, the media in India began running a misinformation campaign against SPH and AIAT and labelled them “traitors”.

⁸⁴ On 20 January 2020 fearing for the safety of one of the other administrators of the all women’s religious university and monastery who moved to Nepal in the light of the above attacks was suspiciously killed in an automobile accident while other women heads of the University were seriously injured in the same¹⁷⁷. It is widely believed that the accident was orchestrated murder by Indian law enforcement authorities trying to chase the AIAT members in a foreign country and is currently under investigation.

⁸⁷ Over the last 27+ years, KAILASA has shown tremendous commitment towards improving the air quality by planting oxygen-rich flora and establishing herbal gardens in the spiritual embassies of KAILASA in over 196 countries.

⁸⁸ Revival of the Hindu tradition of sustainable agriculture including: Organic farming and chemical-free fertilizers - Use of cow dung to grow organic, toxin-free produce. Rainwater harvesting. High-density farming - Planting at a density in excess of that which gives maximum crop yield as means of self-provisioning and increasing the efficiency of the resources. Vertical gardening - Cultivate and nourish vegetation on a vertically suspended panel by using hydroponics.

⁸⁹ Aparigraha, consciously chosen minimalistic simple living as a spiritual lifestyle, is the Hindu solution towards zero wastage. The Sovereign Order of KAILASA live and practice the vow of Aparigraha sincerely, as a means to live life with simplicity, discipline and tremendous internal freedom. Keeping the principle of “Anything which cannot be consumed should not be externally applied on the skin,” KAILASA uses organic-based toiletries and cosmetics such as but not limited to tumeric, haritaki, neem-based body soaps, hair wash, tooth powder and washing detergent. Reduces waste by eliminating shopping, procuring, feeling secure due to the external world wealth and items, materialistic comforts, luxuries and activities. Reduces skin irritation, hormone imbalance, organ toxicity, and even cancer that can be caused by the long term use of non-organic products containing synthetic, man-made chemicals such as sodium laurel, mineral oils, laureth sulfate, petroleum, parabens, and other chemicals that.

⁹⁰ KAILASA, through its network of agencies and organizations collect unwanted items in good condition such as clothing, medical equipment and food from the developed nations, transport them, and distribute them to countries and regions in need, with all transportation and distribution expenses sponsored by KAILASA. https://kailaasa.org/ISHANYA/

Various traditional kingdoms of which the SPH is the reigning emperor have been serving free vegetarian food, with the unique component of aushada annadaan (herbal preparations) to spread health and provide food not just for alleviating physical hunger but also as food for enlightenment. https://gov.shrikailasa.org/category/ishanya-news/

Recommendations

The United Nations should designate SPH as an internationally protected person to bolster confidence among biodiversity and environmental defenders worldwide.

Additionally, the UN should collaborate with KAILASA to safeguard and preserve the planet's ecological integrity, prioritizing the urgent rehabilitation of Earth to ensure a sustainable future for humanity.

¹⁰¹ The "Instrument of Accession" between the Hindu Kings and the Dominion of India was contrary to the Hindu law that governed these Kingdoms, as these kings were merely the stewards of the presiding Deity, having no authority to accede their kingdoms to a non-Hindu entity.

¹⁰³ Through the 42^(nd) Amendment in 1976 in the Constitution of India, this stand was further reasserted with the addition of the word “Secular” to the Preamble of the Constitution of India, thereby further distancing India (Bharat) to its original form as a Hindu nation. This amendment, in spirit, further dissociated India (Bharat) from all religious duties and identities of a Hindu Kingdom, unlike how it always was during its history of more than 10,000 years.

¹⁰⁷ Around 1976, a case of deity theft was filed in the UK court. The suing entity was a juristic person, which was a Hindu Deity. The case involved the repatriation of a stolen Nataraja Deities to India, which had been stolen in the autumn of 1976 from the Aril Thiru Viswanatha Swamy Thanjavur district, Tamil Nadu.

The Indian Government sued Bumper Development Corporation (BDC) and the metropolitan police as co-defendants. The case was fought by a Queen's Counsel, Adrian Hamilton, assisted by the persuasive Bhaskar Ghorpade, barrister-at-law. The Indian Government argued that "once a deity, always a deity. An idol remains a juristic person however long buried or damaged, since the deity and its juristic entity survive the total destruction of its earthly form." The judge concluded that a juristic entity with a title to the Nataraja is superior to that of the defendant. The case set a precedent for regaining stolen temple Deities. It marked the first time a Hindu Deity (embodied form of God as per Hinduism) was recognized as a juristic person in a UK court.

These case references illustrate that the Hindu Law and principles related to Deity Rights and Divine Sovereignty are recognized in Common English Law, not just in some jurisdictions. Also, given the fact that these principles are recognized in Common English Law and applied before Colonization (in Hindu kingdoms under the Hindu constitution), during the colonial era (under Common English Law), and afterward under Indian (which also upholds these principles as illustrated with different case laws), it is clear that these principles are universal and undisputed.

¹⁰⁸ These concepts and principles in India are primarily governed by Hindu law and various judgments by the Supreme Court and High Courts.

One of the landmark cases that dealt with Deities being juristic persons capable of owning property is the case of "Ram Jankijee Deities vs State Of Bihar & Ors (1999) 5 SCC 50". In this case, the Supreme Court of India held that Hindu idols are juristic entities and have the legal status of a minor under the guardianship of the managing trustee or priest of the temple. Implying that the Deity, as a juristic person, can own property, sue, and be sued in court. The property in question is held in trust for the Deity, and the managing trustee or the priest acts on behalf of the deity.

¹⁰⁹ For example, Marthanda Varma, King of Padmanabhapuram, Kingdom of Travancore, in December 1749, declared and dedicated the kingdom to the presiding Deity, Sri Padmanabha, and subsequently assumed the title Padmanabha Dasa (the servant of Lord Padmanabhan). This act is known as Thripadidanam, which meant that the kingdom became the property of Padmanabhaswamy. Since then, the kingdom's sovereign has been the temple's Deity, while the head of the royal family ruled on the Deity’s behalf as guardian and pre-eminent servant (Padmanabha Dasa). Since that day, Travancore has not belonged to any one person or the royal family but to the Lord. The kings merely ruled as vassals of agents of the Deity. Marthanda Varma’s last words to his successor, Rama Varma, were, “No deviation whatever should be made in regard to the dedication of the Kingdom to Sri Padmanabhaswamy, and all further territorial acquisitions should be made over to the Devasom.”

¹¹⁰ The Executive Officers are mere servants of the Deity.

In “State Of Madhya Pradesh & Ors. V. Pujari Utthan Avam Kalyan Samiti & Anr”, (2021) SC 4245, AIR 2021 SC 690, (dated September 6, 2021, available at https://indiankanoon.org/doc/122592345/), the Supreme court ruled that the presiding Deity owns all temple property as a legal person and the name of neither the District Collector (State District Executive) nor the Pujari (priest) be put in the property ownership papers(Revenue records). Paragraph 27 of the judgment mentioned above states, “In the ownership column, the name of the deity alone is required to be mentioned as the deity, being a juristic person is the owner of the land. The occupation of the land is also by the deity, which is carried out by the servant or the managers, on behalf of the deity.” The property of the Deity cannot be used by anybody else.

¹¹¹ In Sabhanayagar Temple, Chidambaram v. State Of Tamil Nadu, (2014) 12 SCC 454 (dated January 6, 2014, available at - https://main.sci.gov.in/jonew/judis/41133.pdf), the court upholds that temple trustee cannot be non-Hindu entity; trustees or managers of a temple must be associated with the Hindu faith, as they are serving the presiding Deity.

This principle is elaborated in paragraph 19 of the judgment, which outlines that religious denomination or a section (including a community of priests, Pontiff of the temple-monastery, etc.) who have been recognized as having the exclusive privilege to participate in the administration, worship, and services to the Deity of the temple, and who have a right established and recognized for several centuries are the rightful trustees.

The judgment also emphasized that such religious denominations or a section (including a community of priests, Pontiff of the temple-monastery, etc.) functioning as trustees have an essential requirement to be associated with the Hindu faith, as they serve in a capacity that is deeply intertwined with the religious and spiritual heritage of the temple.

Similarly, the Andhra Pradesh Endowments Act 1956 (available at https://www.indiacode.nic.in/bitstream/123456789/16889/1/act_no_30_of_1987.pdf) states that Non-Hindus or non-believers should not be appointed as trustees or heads of Hindu temples - "19. Disqualifications for Trusteeship - (1) A person shall be disqualified for being appointed as, or for being, trustee of any charitable or religious institution or endowment - [...] (j) if he does not profess Hindu religion in the case of religious institution or endowment."

Similarly, the Tamil Nadu Hindu Religious and Charitable Endowments Act, Section 10, clearly states that all personnel must be Hindus (https://www.indiacode.nic.in/bitstream/123456789/13275/1/TNHR%26CE%20ACT,%201959%20-%20rev ised%20and%20updated.pdf).

¹¹²However, the Madurai Adheenam is now governed by a non-Hindu entity which is against the Indian constitution

https://www.indiatoday.in/india/tamil-nadu/story/tamil-nadu-madurai-adheenam-desiga-paramacharya-dm k-corruption-hrce-1958910-2022-06-06

¹¹³ Just as in the Chidambaram v. State Of Tamil Nadu (2014) 12 SCC 454, the judgment emphasized that religious denominations or a section (including a community of priests, Pontiff of the temple-monastery, etc.) functioning as trustees have an essential requirement to be associated with the Hindu faith, as they serve in a capacity that is deeply intertwined with the religious and spiritual heritage of the temple, likewise, the executive officers of the system of governance, including laws and constitution, must be derived from the Hindu Jurisprudence (the VedaAgamas and Dharmashastras) and heritage, inherent laws and statutes of the Hindu nation are deeply intertwined with its religious and spiritual heritage.

¹¹⁴ This fact is well understood by the application of the legal principle and international customary law, "Ex injuria jus non oritur," which translates to "Law does not arise from injustice" or, more loosely, "From wrong or unjust action, law (or a right) cannot arise”

This principle is a fundamental concept in international law. It's rooted in the idea that one cannot benefit from wrongdoing. It plays a crucial role in various aspects of international law, including the prohibition of acquiring territory by force and the illegality of agreements or actions contrary to international law. It emphasized that the illegal action (annexation of a Hindu state by threat or force) cannot create legal rights for the wrongdoer.

¹¹⁶ The three ancient Hindu sovereign states of KAILASA, namely the kingdoms of Surya Vamsa Surangi Samrajyam Sarvajnapeetham, Suvarnapeetha Swargapura Samrajya Sarvajnapeetham, Shyamala Peetha Sarvajnapeetham possessed all these characteristics at all time.

However, at various times, temporarily, the control of their territory was lost. But this did not negate the existence of KAILASA, as per the doctrine of continuity, in the international customary law, which, as mentioned before, states that the upheavals and revolutions within a country, changes in governmental forms, the extent of a country's territory, and measures taken during a military occupation do not affect the existence of the State.

¹¹⁷ As a juridical state, KAILASA possesses an international legal personality, which means it can enter into treaties, join international organizations, and raise claims in international courts.
