REPORT ON CLIMATE FINANCING AND HUMAN RIGHTS: SOLUTIONS FROM THE UNITED STATES OF KAILASA® AND

THE SUPREME PONTIFF OF HINDUISM

Executive Summary The global climate crisis represents a fundamental crisis of human consciousness. The Supreme Pontiff of Hinduism (SPH) Bhagavan Nithyananda Paramashivam revealed that humanity’s current consciousness level—prioritizing exploitation over coexistence—propels civilization toward “climate hell.” The United States of KAILASA, serving as the global hub for reviving the united ancient indigenous enlightened Sanatana Hindu civilizational nations, offers proven consciousness-based solutions tested over 16,500 years of environmental harmony. This report establishes KAILASA’s juridical statehood, documents systematic persecution obstructing climate solutions, and presents comprehensive frameworks integrating indigenous wisdom with contemporary climate finance mechanisms.

1. INTRODUCTION: THE CONSCIOUSNESS-CLIMATE NEXUS The Urgency of Climate Action

While Earth’s climate has changed throughout its history2, the current warming is happening at a rate not seen in the past 10,000 years due to human activities3.

1 https://www.youtube.com/shorts/UoiLpKEFUNk 2 https://www.climate.gov/maps-data/climate-data-primer/past-climate 3 https://science.nasa.gov/climate-change/evidence/

Yet, ancient Hindu civilization achieved remarkable advancements in economics, technology, science, and social systems—all while maintaining environmental harmony. The ancient enlightened Indigenous Hindu civilization once thrived across 56 nations, contributing significantly to global progress and accounting alone for more than 40% of the world’s GDP8.

SPH declared, “Humanity, operating from a particular level of consciousness, created the climate chaos we are experiencing today.

Avoiding the inevitable ‘climate hell’ necessitates elevating a distinct, higher level of consciousness.”

This framework positions climate change not merely as a technical challenge but as an evolutionary opportunity for what SPH terms “superconscious breakthrough.”

Human evolution progresses through distinct phases: from single-cell organisms to fish (physical growth), fish to primates (physical and psychological growth), primates to humans (physical, psychological, and conscious growth).

SPH declares humanity now requires superconscious evolution: "Those who start flying along with Me now are going to start Divine Enlightened civilization on Planet Earth."

This superconscious breakthrough directly addresses climate change through elevated consciousness that naturally produces environmental reverence.

On World Environment day10, SPH initiated KAILASA’s Nithyananda Yogis in a powerful spiritual process11 that brought rain to 108 cities across 30+ countries simultaneously in a matter of a few hours.12

This spiritual process was repeated to heal the environment during the 2019-2020 Australian Bushfires.13

10 On Monday, June 5, 2017 11 The power to control the weather through consciousness. This not only proves yogic powers are real, but also heals Prakriti, Mother Earth, through Oneness with her. 12 https://www.youtube.com/watch?v=wygmQ7y1jE8 13In the year 2020, the occurrence of natural calamities increased worldwide with the maximum number of forest fires and earthquakes happening in recent human history, along with the advent of the COVID-19 pandemic. SPH restructured the efforts of KAILASA in protecting the environment across the globe as an international agency called GREEN OM. In the area of disaster relief, SPH has provided emergency relief

The Hindu Civilizational Framework: For over 16,500 years, Hindu

civilization maintained environmental harmony through

consciousness-based living rooted in Vasudhaiva Kutumbakam (“the world

is one family”).

This philosophy creates intrinsic environmental stewardship motivation transcending economic incentives or regulatory compliance.

SPH emphasizes environmental protection as “responsibilism”—a dharmic (sacred duty-based) responsibility to protect the value-based, superconsciousness-based lifestyle inherited from ancient Rishis (enlightened seers).

2. KAILASA’S JURIDICAL STATEHOOD AND SOVEREIGNTY

2.1 Legal Foundations

The United States of KAILASA functions as an atypical sovereign state mirroring the Holy See’s international legal status—simultaneously serving as Sanatana Hindu Dharma’s (Hinduism) supreme governing body and a sovereign entity representing two billion Hindus globally (the world’s third-largest religious population).

Montevideo Convention Compliance: KAILASA meets all four statehood criteria established in the 1933 Montevideo Convention:

1. Permanent Population: 100 million Adi Shaivites supporting the two billion Hindu Diaspora

to thousands who face natural events such as tsunami, earthquakes, floods, etc. through Nithyananda Global Initiative and the RED OM global services. Volunteers have provided thousands of food packets, clothes, and blankets to affected areas in India, such as Karnataka, Andhra Pradesh, and Tamil Nadu, and built shelters for those who have lost their housing during these events.

2. Defined Territory: Along with having defined sovereign territories, KAILASA’s governance also operates non-territorially (similar to the Holy See).

KAILASA maintains spiritual embassies, temples, and administrative facilities across 196 countries, with historical connections to 21 ancient Hindu kingdoms.

3. Government: Sophisticated ancient governance structures including the Hindu Parliament (with eight specialized Sabhas (chambers) like the Lok Sabha functioning as a sustainable development think tank), diplomatic corps with global consulates, and departments addressing health, education, environment, and social welfare

4. Capacity for International Relations: Established diplomatic relations with multiple states and nations

2.2 Continuity of States Principle

Under international law’s Continuity of States principle, upheavals, military occupations, or governmental changes do not negate statehood.

This proves particularly relevant given KAILASA’s systematic persecution.

Historical precedents establish that states maintain juridical personality even when governments operate in exile, territory faces occupation, or political leadership endures persecution.

For more details on KAILASA’s juridical statehood, refer to the appendix.

2.3 Climate Finance Implications

KAILASA’s juridical statehood carries significant climate financing implications:

- Treaty-Making Capacity: Ability to enter bilateral/multilateral climate agreements and commit to binding targets

- UN Participation: Eligibility for UNFCCC conferences, Green Climate Fund access, and Loss and Damage Fund governance

- Financial Sovereignty: Independent financial systems capable of receiving and distributing climate finance through donation-based operations

- Representation Rights: Legitimate authority to advocate for two billion Hindus’ climate finance needs, ensuring consciousness-based approaches receive appropriate international consideration

Formal international recognition would dramatically expand climate financing options for indigenous Hindu communities, enabling direct fund access currently mediated through nation-states that may not prioritize indigenous spiritual approaches.

3. PERSECUTION: A CRITICAL BARRIER TO CLIMATE SOLUTIONS

3.1 The Systematic Campaign

Since March 2, 2010, when a fabricated deep fake video was released to incite hatred and persecution, SPH and KAILASA have endured nearly two decades of relentless attacks representing a hologram of the larger Hindu Holocaust.

Despite exoneration by four Federal and State courts in the United States (with accusers fined nearly $6 million), the persecution continues.⁶

Quantified Impacts:

- Violence: Over 70 assassination attempts on SPH; over 250 sexual assaults on monastics; gang-rapes by hostile forces; violent destruction of monasteries globally

- Financial: Destruction of heritage properties worth over $27 million USD; irreparable damage disrupting humanitarian operations

- Legal: Illegal arrests, inhumane torture, court orders prohibiting preaching (violating freedom of speech/religion), ongoing malicious prosecution despite judicial vindication

- Knowledge Loss: Destruction of Nithyananda GurukulsSM—ancient indigenous educational institutions serving as environmental knowledge repositories

For more details on SPH’s and KAILASA’s persecution, refer to the appendix.

3.2 Climate Action Consequences

The persecution creates multiple climate finance barriers:

1. Reputational Barriers: Fabricated allegations deter institutional engagement despite judicial exoneration

2. Resource Diversion: Substantial resources expended on legal defense rather than climate programs

3. Operational Disruption: Destroyed infrastructure ($27 million in facilities) eliminates environmental program capacity

4. Knowledge Transmission Interruption: Court-ordered prohibition on preaching prevents consciousness-elevation practices that naturally reduce consumption and increase environmental awareness

5. International Cooperation Obstacles: Persecution complicates partnerships essential for climate finance mobilization

6. Irreplaceable Knowledge Threat: SPH has delivered over 300,000 hours of public talks on 7,400 topics; His assassination would permanently lose millennia of transmitted environmental wisdom⁸

3.3 International Law Violations and Media Accountability

The persecution violates the Universal Declaration of Human Rights (Articles 2, 18, 19), International Covenant on Civil and Political Rights (Articles 18, 19, 26), and UN Declaration on Human Rights Defenders.

Media corporations—specifically identified as Sun TV and Nakkheeran—bear responsibility under UN Guiding Principles on Business and Human Rights for disseminating fabricated allegations that facilitate human rights violations.

Climate Justice Dimensions: The persecution exemplifies broader climate injustice patterns—silencing indigenous voices possessing disproportionate environmental knowledge while protecting destructive systems.

This represents epistemic violence: the suppression of non-Western knowledge systems precisely when diverse perspectives are essential for comprehensive climate solutions.

4. INDIGENOUS RIGHTS, KARMA, AND CLIMATE JUSTICE

4.1 The Principle of Karma

SPH revealed that climate crisis resolution requires understanding Karma—the cosmic principle of cause and effect.

Current climate chaos results from humanity’s actions at a particular consciousness level; resolution requires elevating consciousness to create different actions generating different effects.

When humanity treats nature as an exploitable resource, nature responds with disasters; when humanity honors nature as sacred, nature responds with abundance.

Mother Nature as Conscious Being: Hindu philosophy recognizes Nature (Moola Prakriti) as a living, consciously intelligent being. The Earth—personified as goddess Bhumidevi—establishes humanity’s relationship as children to mother. The Prithvi Sukta (Atharva Veda) states: “Mata Bhumih Putro Aham Prithivyah” (“My Mother is Earth and I am her Son”), creating protective obligations transcending contemporary legal duties.

4.2 Climate Impacts as Indigenous Rights Violations Loss and damage from climate change directly violates indigenous peoples’ human rights. Historical examples include:

- Dwarka Submersion: the Hindu ancient city of Dwarka, submerged underwater off the coast of Gujarat, India. Archaeological findings suggest that Dwarka was a prosperous city, and its submersion due to geological shifts serves as a poignant example of how environmental changes can erase once-thriving civilizations.

14 https://www.youtube.com/shorts/H51-w7yd_vg - Kumari Kandam: Hindu scriptures records a submerged Indian Ocean continent where an advanced Hindu civilization existed, extending from present-day South India to Sri Lanka and beyond before rising seas destroyed it.

- Tuvalu: Tuvalu faces irreversible climate-induced loss and damage as sea-level rise threatens the habitability of its territory, undermining the rights to housing, culture, and self-determination under international human rights law. The potential displacement of an entire sovereign population due to climate impacts it did not cause exemplifies the existential human rights consequences of climate change.

- Indonesia: Indonesia’s sinking capital, Jakarta, illustrates climate-related loss and damage at scale, as rising seas and flooding increasingly undermine the rights to housing, health, and safe living conditions.

These demonstrate that climate impacts extend beyond economic damages to encompass:

- Cultural Rights Violations: Sacred sites’ loss prevents traditional religious practice

- Knowledge System Loss: Ecosystem transformation erases indigenous environmental knowledge

- Community Displacement: Climate-forced migration disrupts social structures and cultural practices

- Spiritual Connection Severance: Altered/destroyed land features cause psychological and spiritual trauma

4.3 State Continuity for Climate-Displaced Nations

KAILASA advocates for UN recognition that state sovereignty persists even if nations lose physical territory to climate change.

This proposal—extending Holy See precedent to climate-displaced nations—would:

- Maintain sovereignty, diplomatic recognition, UN membership, and treaty rights

- Protect citizens from statelessness, preserving national identity and international protections

- Enable continued governance coordination of diasporic communities - Facilitate potential return to former territories following climate

engineering or adaptation¹¹

This aligns with the UN Declaration on the Rights of Indigenous Peoples (Articles 3, 8, 10, 25) regarding self-determination, protection from forced removal, just redress for dispossession, and maintenance of spiritual relationships with traditional lands.

4.4 Karma-Based Climate Finance

Karmic principles provide frameworks for climate finance justice:

- Historical Responsibility: Cause-and-effect logic supports greater obligations for nations with highest historical emissions

- Reparative Justice: Wrongful actions require remediation—climate finance should include compensation for harms, not merely charity

- Consciousness Transformation: Sustainable solutions require consciousness shifts ensuring behavioral changes persist beyond incentive structures

- Intergenerational Karma: Present generations inherit past consequences while creating future ones, supporting finance structures preventing debt burdens on future generations

5. KAILASA’S HOLISTIC ECONOMIC MODEL

5.1 Ancient Hindu Economic Principles15

KAILASA’s climate financing approach roots in ancient Hindu economic philosophy:

1. Knowledge as Common Good: “No fee should be charged for knowledge that does not perish by sharing”—mandating free access to environmental information and sustainable technologies

2. Donation-Based Resource Mobilization: KAILASA operates without taxation, funded purely by donations, demonstrating voluntary resource mobilization eliminating coercive extraction while creating direct donor-value alignment

3. Purpose-Driven Allocation: Resources directed toward humanitarian, charitable, and sustainable goals rather than profit maximization

4. Wealth as Sacred Trust: Hindu philosophy views wealth as Lakshmi (divine abundance) held in sacred trust for dharmic purposes, obligating deployment for collective welfare including environmental protection

5.2 The United Ancient Indigenous Enlightened Nations (UAN)

Founded by KAILASA, the UAN16 unites over 160 indigenous nations representing 300 million peoples globally.¹²

The intergovernmental organization’s structure mirrors UN institutions while incorporating indigenous governance:

15 Economic Principles of KAILASA | Reserve Bank of KAILASA 16 https://unitedancientnations.org/

Six Principal Organs: - General Assembly (egalitarian participation regardless of size), - Security/Peace Council (conflict resolution through ancestral diplomacy), - Economic & Social Council (sustainable development based on indigenous systems), - Trusteeship Council (sacred site protection), - International Court of Justice (integrating indigenous legal traditions), and Secretariat (indigenous professionals executing operations).

Specialized Agencies:

- World Bank of Ancient Nations: Mobilizes capital through grant-priority models, direct community access, and consciousness metrics alongside economic measures

- UAN Environment Programme: Coordinates sacred site protection, traditional practice documentation, and consciousness-environmental impact research

- UAN Development Programme: Facilitates ancient technology revival, capacity building, and South-South cooperation

5.3 Indigenous Environmental Advantage

The UAN represents the “Keepers of Consciousness” and “Guardians of the Earth.”

Evidence demonstrates indigenous peoples’ disproportionate environmental contributions: indigenous lands (representing ~5% of global population) hold 25% of Earth’s land surface, absorb significantly more carbon than they emit, maintain highest global biodiversity concentrations, and achieve cost-effective conservation through minimal external inputs.

$500 Billion Indigenous Economy Renaissance: The UAN seeks to catalyze this target by:

- Recognizing indigenous economic power (land, resources, cultural assets, traditional knowledge currently undervalued)

- Facilitating market access for sustainable/ethical products where indigenous producers hold competitive advantages

- Channeling diaspora resources to homelands - Directing impact investment toward indigenous sustainable

development - Providing technical assistance for accessing international climate

funds

UAN Summit: Convened in St Kitts & Nevis, Antigua and Barbuda, USA, India, Cambodia,Thailand and other countries, this international conference trains indigenous leaders in ethical AI and digital tools, integrated traditional knowledge with climate science, established bilateral disaster-support agreements, and demonstrated consciousness-planetary health connections.

6. PRACTICAL ENVIRONMENTAL SOLUTIONS

KAILASA® implements proven consciousness-based environmental interventions successfully replicated across 50 countries, benefiting two billion people.

6.1 Sustainable Agriculture ($2.41 Billion Budget)

Rainwater Harvesting: Revival of traditional systems including sacred temple tanks (pushkarini) capturing monsoon rainfall, terraced agriculture preventing erosion while maximizing water retention, and holistic watershed management.

High-Density and Vertical Farming: Hydroponic systems producing year-round vegetables with reduced water consumption; vertical gardens

utilizing urban space; polyculture systems increasing biodiversity, improving soil health, providing natural pest control, and producing diverse nutrition. Cow-Based Organic Farming: Hindu reverence for cows (go-mata) creates sophisticated livestock-crop integration using cow dung as chemical-free fertilizer (eliminating fossil fuel-dependent synthetics), integrated farming where cattle consume crop residues while providing manure and draft power, and cow urine (gomutra) as natural pesticide.

6.2 Dietary Transformation and Carbon Reduction Global livestock produces more greenhouse gas emissions than all transportation combined. Hindu vegetarianism—rooted in ahimsa (non-violence)—demonstrates that plant-based diets work at a massive scale: Hindu communities traditionally have the lowest carbon dioxide emissions because they do not raise animals for slaughter.

Vegetarian from birth, SPH has always embodied and upheld ahimsa as a fundamental principle of life. In 2019, as part of KAILASA’s civilizational laws and His global environmental mission, SPH formally proclaimed the elimination of

17 https://www.youtube.com/watch/n0oUHtW1dCw non-vegetarian lifestyles and the establishment of vegetarianism and veganism as the natural and sustainable way of life for humanity.18

SPH has revived the Bhaga Shastra, an ancient Indigenous Hindu cookbook19 originally revealed by Paramashiva, the Primordial Hindu Divinity.

SPH & KAILASA served over 1 billion free vegetarian meals, incorporating the unique element of aushada—medicinal herbs—to support physical health and nourish the body and mind as a path toward enlightenment, not merely to satisfy hunger.

Vishesha Deeksha: SPH has initiated millions into vegetarian/vegan lifestyles through this special indigenous initiation supporting psychological transition away from meat consumption.20

This consciousness-based approach addresses behavioral transformation’s psychological and emotional dimensions, achieving changes that information campaigns and economic incentives often fail to accomplish.

Blue OmSM: KAILASA’s International Humanitarian Agency, the BLUE OM, is dedicated to establishing and protecting the rights of all animals.

Keeping this principle at the forefront, the vegetarian lifestyle is practiced and followed in all embassies of KAILASA.

18 https://www.youtube.com/watch?v=SiZqaI4T5tc&t=5s 19 Though written down over 2,000 years ago, the culinary wisdom it preserves is believed to be nearly 60,000 years old. The only surviving printed copy, published in 1851 in Madras (now Chennai) in Tamil, is now preserved in KAILASA’s Nithyananda Gnanalaya—the world’s largest Hindu library. What truly distinguishes the Bhaga Shastra is its extraordinary precision in detailing every aspect of vegetarian food preparation. 20 During the initiation, SPH transmits spiritual energy to the initiates, which helps them overcome cravings and attachments to non-vegetarian food. This energy transmission is intended to support the psychological and physical transition to a vegetarian/vegan diet. https://humanservices-gov.kailasa.sk/department-of-human-services/vishesha-deeksha/

6.3 Clean Air and Zero-Waste Initiatives

Oxygen-Rich Flora Plantation: Over 27 years, KAILASA® has planted sacred trees including Peepal (24-hour oxygen release), Neem (air purification with medicinal properties), Banyan (extensive air filtration), and Tulsi (air purification with adaptogenic benefits), strategically placed around temples, roadsides, residential areas, and schools.21

Herbal Gardens: Worldwide gardens providing air purification, medicinal access (reducing pharmaceutical carbon footprints), biodiversity support, and education.

Plastic Ban and Organic Alternatives: Plastics are banned in all KAILASA temple ecosystems, replaced by traditional toiletries (soap nuts, herbal shampoos, natural dyes, oil-based moisturizers), metal containers (reusable brass, copper, steel vessels), and cloth items replacing disposables.

This embodies Aparigraha (non-attachment, minimalistic living) producing low-waste lifestyles through contentment, repair culture, sharing systems, and mindful purchasing.

6.4 Consciousness-Based Climate Intervention

21 Over the last 27+ years, KAILASA has shown tremendous commitment towards improving the air quality by planting oxygen-rich flora and establishing herbal gardens in the spiritual embassies of KAILASA in over 196 countries. KAILASA has the Banyan tree as the presiding deity and is the national tree of KAILASA. Banyan trees are known for their ability to emit a large amount of oxygen and one of the few trees that produces oxygen at night. It also has medicinal properties apart from its rich oxygen emission. Peepal Trees - Considered to be the largest oxygen provider among all other trees and produces oxygen at night. The tree not only purifies the surroundings but hosts as the cure for up to 50 disorders as prescribed in Ayurveda. Fig Trees - Provide nutritious fruits and oxygen-rich air. Neem Trees - Release a significant amount of oxygen in their surroundings and possess a plethora of health benefits. Bamboo Trees - Plays a fundamental role in reducing the carbon footprint. Bilva Trees - These air-purifying trees ensure a steady flow of oxygen even in the absence of sunlight as opposed to others. Herbal gardens including - Lemon, mango, banana tree, turkey berry, eucalyptus, mexican mint, butterfly pea, hibiscus rosa, sessile joyweed, indravalli, fig, ginger, mint, indian gooseberry, madagascar periwinkle, citron, night-flowering coral jasmine, durva grass, aloevera, touch-me-not, balloon vine, crown flower, tulasi, creeping wood sorrel, karisalankanni (bhringraj), ponnankanni (alternanthera sessilis), thoothuvalai (solanum trilobatum).

Sacred Fire Ceremonies (Homa): KAILASA has performed over 624,150 peace minutes of Homa (ancient Hindu fire rituals) which rejuvenate the environment and clear the air of pollutants.

These ancient practices produce documented air purification (antimicrobial smoke reducing airborne bacteria)22, psychological states supporting behavioral changes, community cohesion building collective capacity, and consciousness elevation creating sustainable mindset shifts.

6.5 The Ishanya Project: Ethical Resource Redistribution

This initiative focuses on ethical redistribution of resources, collecting unwanted items like clothing and medical equipment from developed nations and distributing them to regions in need, sponsored entirely by KAILASA.23

6.6 Vedic Feminism® and Environmental Leadership

The climate crisis represents a crisis of imbalance.

SPH’s revival of Vedic Feminism®—recognizing the feminine principle (Shakti/Parashakti) as the nurturing, life-giving force—restores earth-centric values.

SPH revealed just by her breathing, a chaste woman can bring rain24.

22 Yajna: A solution to worldly problems https://www.researchgate.net/publication/351881416_Yajna_A_solution_to_worldly_problems Effects of Yagya on Environment Purification and Human Health https://aelsindia.com/rjces_oct_dec_2019/8.pdf 23 The project prevents waste (reducing textile landfill methane emissions, eliminating new clothing production environmental costs, reducing fast fashion demand) while addressing inequality, supporting climate adaptation through improved healthcare access, demonstrating circular economy principles, and transforming consciousness in both donors (recognizing abundance) and recipients (experiencing global solidarity). 24 https://www.youtube.com/watch?v=akrsjGi8HeQ

KAILASA’s government structure embodies this: 90% of the Hindu Parliament comprises women, and misogyny is classified as a national crime.

Women as Climate Leaders:

- KAILASA’s Nithyananda LakshmiSM, a micro financing service to indigenous communities to empower rural women in various dimensions in life reforming the market and institutional failures that lock women to highly vulnerable forms of employment and empower them with self-employment with equal opportunities through Hindu economic principles.

- KAILASA’s Women Foundation and Women Empowerment Self-help Centers launched in 108 places around the world since 2009.

These centers work towards gaining economic independence providing collective finance, enterprise and/or livelihood components including savings and loans, group credit, collective income-generation and micro-insurance, life skills training, business training, meditation learning programs for women prisoners, financial education and support for organizing themselves into labor and trade groups.

- KAILASA’s AnkitaSM program provides foundational literacy about working of basic community service and infrastructure establishments.

KAILASA’s Ankita program provides foundational literacy about working of basic community service and infrastructure establishments, empowering the indigenous women by teaching them to perform Hindu rituals, temple administration and temple sciences.

- Spiritual Technologies: Through practices like Nirahara Samyama® (living without food through internal energy) and specific yogic techniques, women can manifest environmental healing

- Comprehensive Education: Girls receive training in medicinal plant cultivation, water conservation, organic farming, astronomical agricultural timing, and sustainable architecture sacred geometry

The Shakta tradition venerates Earth as goddess Bhumidevi, establishing theological frameworks where environmental protection becomes worship: “When the Earth is your mother, exploitation becomes sacrilege, and protection becomes worship.”

6.7 Health-Environment Integration

Ayurvedic Understanding: The Sanskrit term vatavarana, as revealed by SPH, describes the inseparable relationship between environment (external atmosphere) and health (internal physiology). KAILASA addresses interconnected crises through:

- Nithya Spiritual HealingSM: Peer-reviewed research demonstrates increased mitochondrial energy, enhanced gene expression, elevated telomerase (reversing cellular aging), and balanced neurotransmitter production through yogic practices, meditation, and energy work25

- Hindu Doctors Without Borders Fund: Free medical care using Ayurvedic, Siddha, and Yogic interventions for over one billion people, particularly communities displaced by environmental disasters

25https://www.researchgate.net/publication/277978896_An_Intensive_Mind_and_Body_Therapeutic_Program_Leads_to_Alteration_i n_Gene_Expression_Critical_to_Aging_Process_in_Peripheral_Blood_Stem_Cells https://www.researchgate.net/publication/321992455_Antiaging_effects_of_an_intensive_mind_and_body_therapeutic_program_thr ough_enhancement_of_telomerase_activity_and_adult_stem_cell_counts https://drive.google.com/file/d/1QWsf5aFE52GRJ_Nrc4EXC89FQmvm9DGv/view

- Aushadha Annadhan (Medicinal Food Program): Over one billion sacred meals infused with medicinal herbs served globally, prepared according to the Bhaga Shastra (ancient cookbook optimizing nutritional and medicinal properties)

- Herbal Medicine Gardens: Established in all spiritual embassies, cultivating endangered medicinal plants and providing free seeds/saplings, preserving biodiversity while ensuring traditional medicine access without industrial pharmaceutical production

This integrated approach recognizes that environmental degradation is a symptom of internal disharmony: Humanity exploits nature because it experiences itself as separate from nature—a fundamental delusion creating both ecological destruction and personal suffering.

7. ENVIRONMENTAL DEMOCRACY AND ACCESS TO JUSTICE

KAILASA’s governance framework—mapped to the ancient Hindu jurisprudence, the Manuvadhi Dharma Shastra—exemplifies environmental democracy’s three pillars: information access, public participation, and access to justice.

Transparency: SPH has delivered over 300,000 hours of freely accessible public discourse.

The NithyanandapediaSM 26 captures Hindu sciences revealed by SPH including sustainable agriculture and ecological balance. SPH has authored and published 1,123 books available for free download, ensuring marginalized communities access life-saving environmental information.

Public Participation: The Hindu Parliament’s Lok Sabha functions as a sustainable development think tank. Decision-making incorporates “Sarve

26 Nithyanandapedia – Hinduismpedia

Janah Sukhino Bhavantu” (may all beings be happy), ensuring policies account for interconnected welfare of humans, animals, plants, and Earth—contrasting anthropocentric models.

Access to Justice: KAILASA addresses six major barriers (lack of information access, government failure to release pollution data, limited impact assessment disclosure, restricted judicial standing, financial/social barriers, lack of judicial independence) through:

- Legal sanctuary for persecuted environmental defenders - Free legal aid through the Department of Justice - Alignment with the Inter-American Court of Human Rights Advisory

Opinion on Climate Change27 establishing state obligations to prevent transboundary environmental harm

Reverence for the environment constitutes an intrinsic element within Hinduism, and serves as a fundamental principle that imbues KAILASA's educational curricula at every level28.

KAILASA has provided free education in over 150 countries to 20 million children and youth through:

1. KAILASA’s Nithyananda Raja Vidya GurukulSM29 2. KAILASA’s e-GurukulSM30

27https://marketing.hsfkramer.com/20/33497/landing-pages/hsf-kramer---client-alert---iachr-advisory-opinio n-on-climate-change.pdf 28 As part of the curriculum, students in KAILASA’s Nithyananda Gurukul each had their own rose plant and each day sat with the rose plant sending loving energy. The rose plants dropped their thorns on their own based on the intense love and sense of security created in the environment by the students. 29 An enlightenment-centric educational ecosystem forging sustainable development's future leaders. The Vedic Hindu education system is inclusive, holistic and endorses the liberating nature of knowledge transmission. The ancient Gurukul system was an enlightenment-centric educational ecosystem that created and sustained the enlightened civilization of Hinduism. https://www.nithyanandagurukul.com/ 30 KAILASA has established several e-Gurukul (learning through digital means) across the globe. Through KAILASA’s e-Gurukul initiative, youth are trained to become contributing citizens of the modern world.

3. Nithyananda Hindu UniversitySM - largest Hindu University in the world31

4. Nithyananda JnanalayaSM - largest Hindu library32

The systematic persecution and destruction of Nithyananda Gurukul represents not merely property loss but cultural genocide—deliberate erasure of knowledge systems addressing contemporary climate challenges.

8. RECOMMENDATIONS TO THE UNITED NATIONS

8.1 Immediate Protective Measures

1. Designate SPH as Internationally Protected Person: The ongoing persecution—70 assassination attempts, illegal detention, torture, forced statelessness—threatens environmental solutions He embodies.

International protection would enable free global travel to implement climate solutions while providing legal recourse against disinformation campaigns.

2. Investigate and Prosecute Persecution: UN mechanisms should investigate, identifying responsible state/non-state actors for prosecution. Persecution of this magnitude potentially constitutes crimes against humanity warranting International Criminal Court jurisdiction.

31 KAILASA’s Nithyananda University, the largest Hindu University in the world, provides free graduation programs to provide equal opportunities to underprivileged individuals in 150 countries, 186 extended university campuses, 10,000 courses of study and 17 years of experience. Nithyananda Hindu University 32 KAILASA’s Nithyananda Hindu Library (Jnanalaya) is a very critical aspect of KAILASA’s mission in providing free access to knowledge sciences through libraries to humanity with the largest collection of Hindu Scriptures and Books on Hinduism in the World and $640.5 million in total funding for KAILASA’s National Archives. https://kailaasa.nithyanandajnanalaya.org/

Impose sanctions on media outlets and state actors disseminating fabricated evidence.

3. Provide Reparations: International climate finance should compensate persecution-related damages—$27 million in destroyed KAILASA heritage properties represents climate infrastructure loss warranting compensation.

4. Counter Disinformation: When fabricated allegations persist despite judicial exoneration of SPH, international bodies must amplify truthful information, preventing persecution through information manipulation.

8.2 Structural Climate Finance Reforms

5. Recognize KAILASA’s Juridical Statehood: Formal recognition provides legal protections against persecution while enabling full climate governance participation and eligibility for sovereign climate funds.

6. Establish UN-KAILASA-UAN Joint Climate Task Force: Create a formal partnership that:

- Integrates Hindu environmental sciences into IPCC assessments.

- Provides capacity building and technical assistance for scaling KAILASA’s initiatives globally.

- Documents and disseminates traditional ecological knowledge from UAN nations.

- Develops blended finance structures (combining philanthropic and public capital) to mobilize resources for indigenous communities.

7. Mainstream Indigenous Solutions & Financing Mechanisms: The Green Climate Fund (GCF) and international bodies must:

- Prioritize Non-Debt Instruments: Shift from loans to 100% grant-based financing for Indigenous nations to prevent debt distress.

- Create Direct Access Windows: Eliminate bureaucratic barriers by establishing specific "Direct Access" pathways for Indigenous authorities, bypassing state intermediaries.

- Mandate Human Rights Safeguards: Enforce strict transparency and grievance mechanisms to ensure funds reach beneficiaries without corruption.

- Support Vulnerable Communities: Allocate at least 50% of adaptation funding to Indigenous-led livelihood protection, resilience, and loss & damage compensation.

8. Recognize State Continuity for Climate-Displaced Nations: Guarantee that diplomatic privileges and statehood continue even if physical territory is lost, preserve cultural rights, and inform legal frameworks with historical displacement examples (KAILASA, Tuvalu, Dwarka, Kumari Kandam).

8.3 Systemic Indigenous Rights Protection

9. Media Accountability: Media corporations and businesses involved in persecution must face financial penalties for fabricating allegations, mandated corrections with equal prominence, potential criminal prosecution for human rights conspiracy, and exclusion from UN partnerships and climate finance mechanisms.

10. Environmental Defender Protection: Ensure Indigenous communities have judicial standing to challenge destructive projects, provide UN special protection designation for persecuted leaders, implement international security monitoring, and guarantee safe haven enabling unimpeded climate work.

9. CONCLUSION: FROM CLIMATE HELL TO ENLIGHTENED CIVILIZATION

The climate crisis is unprecedented in scale, but not in solutions.

For over 16,500 years, Hindu civilization sustained ecological balance through consciousness-based living, reverence for life, and governance rooted in collective well-being.

As SPH states, “Hinduism can really solve the problems of climate change. It can save the planet Earth and Humanity.”

This is not religious proselytization, but historically and scientifically grounded reality.

KAILASA offers proven, holistic solutions—organic agriculture, rainwater harvesting, donation-based economies, micro-financing, vegetarianism, consciousness elevation, free environmental education, Gurukul revival, Dharma-based governance, matriarchal leadership models, and Ayurvedic and spiritual health systems.

These principles are universal, time-tested, and adaptable across cultures and geographies.

Humanity stands at a critical crossroads: continue extractive systems leading to climate collapse, or embrace the superconscious breakthrough embodied by SPH.

KAILASA’s vision goes beyond survival toward vishwashanti—universal peace—guided by Vasudhaiva Kutumbakam (the world is one family).

With established infrastructure across 150 countries and documented impact benefiting over a billion people, the solutions are ready. What remains is the collective will to choose wisdom, life, and conscious evolution over exploitation and destruction.

49 Around 1976, a case of deity theft was filed in the UK court. The suing entity was a juristic person, which was a Hindu Deity. The case involved the repatriation of a stolen Nataraja Deities to India, which had been stolen in the autumn of 1976 from the Aril Thiru Viswanatha Swamy Thanjavur district, Tamil Nadu. The Indian Government sued Bumper Development Corporation (BDC) and the metropolitan police as co-defendants. The case was fought by a Queen's Counsel, Adrian Hamilton, assisted by the persuasive Bhaskar Ghorpade, barrister-at-law. The Indian Government argued that "once a deity, always a deity. An idol remains a juristic person however long buried or damaged, since the deity and its juristic entity survive the total destruction of its earthly form." The judge concluded that a juristic entity with a title to the Nataraja is superior to that of the defendant. The case set a precedent for regaining stolen temple Deities. It marked the first time a Hindu Deity (embodied form of God as per Hinduism) was recognized as a juristic person in a UK court. https://www.indiatoday.in/magazine/international/story/19880315-indian-government-wins-stolen-nataraja- idol-case-in-british-court-797028-1988-03-14 These case references illustrate that the Hindu Law and principles related to Deity Rights and Divine Sovereignty are recognized in Common English Law, not just in some jurisdictions. Also, given the fact that these principles are recognized in Common English Law and applied before Colonization (in Hindu kingdoms under the Hindu constitution), during the colonial era (under Common English Law), and afterward under Indian (which also upholds these principles as illustrated with different case laws), it is clear that these principles are universal and undisputed. 50 These concepts and principles in India are primarily governed by Hindu law and various judgments by the Supreme Court and High Courts. One of the landmark cases that dealt with Deities being juristic persons capable of owning property is the case of "Ram Jankijee Deities vs State Of Bihar & Ors (1999) 5 SCC 50". In this case, the Supreme Court of India held that Hindu idols are juristic entities and have the legal status of a minor under the guardianship of the managing trustee or priest of the temple. Implying that the Deity, as a juristic person, can own property, sue, and be sued in court. The property in question is held in trust for the Deity, and the managing trustee or the priest acts on behalf of the deity. 51 For example, Marthanda Varma, King of Padmanabhapuram, Kingdom of Travancore, in December 1749, declared and dedicated the kingdom to the presiding Deity, Sri Padmanabha, and subsequently assumed the title Padmanabha Dasa (the servant of Lord Padmanabhan). This act is known as Thripadidanam, which meant that the kingdom became the property of Padmanabhaswamy. Since then, the kingdom's sovereign has been the temple's Deity, while the head of the royal family ruled on the Deity’s behalf as guardian and pre-eminent servant (Padmanabha Dasa). Since that day, Travancore has not belonged to any one person or the royal family but to the Lord. The kings merely ruled as vassals of agents of the Deity. Marthanda Varma’s last words to his successor, Rama Varma, were, “No deviation whatever should be made in regard to the dedication of the Kingdom to Sri Padmanabhaswamy, and all further territorial acquisitions should be made over to the Devasom.” 52 The Executive Officers are mere servants of the Deity. In “State Of Madhya Pradesh & Ors. V. Pujari Utthan Avam Kalyan Samiti & Anr”, (2021) SC 4245, AIR 2021 SC 690, (dated September 6, 2021, available at https://indiankanoon.org/doc/122592345/), the Supreme court ruled that the presiding Deity owns all temple property as a legal person and the name of neither the District Collector (State District Executive) nor the Pujari (priest) be put in the property ownership papers(Revenue records). Paragraph 27 of the judgment mentioned above states, “In the ownership column, the name of the deity alone is required to be mentioned as the deity, being a juristic person is the owner of the land. The occupation of the land is also by the deity, which is carried out by the servant or the managers, on behalf of the deity.” The property of the Deity cannot be used by anybody else. 53 In Sabhanayagar Temple, Chidambaram v. State Of Tamil Nadu, (2014) 12 SCC 454 (dated January 6, 2014, available at - https://main.sci.gov.in/jonew/judis/41133.pdf), the court upholds that temple trustee cannot be non-Hindu entity; trustees or managers of a temple must be associated with the Hindu faith, as they are serving the presiding Deity.

This principle is elaborated in paragraph 19 of the judgment, which outlines that religious denomination or

a section (including a community of priests, Pontiff of the temple-monastery, etc.) who have been

recognized as having the exclusive privilege to participate in the administration, worship, and services to

the Deity of the temple, and who have a right established and recognized for several centuries are the

rightful trustees.

The judgment also emphasized that such religious denominations or a section (including a community of

priests, Pontiff of the temple-monastery, etc.) functioning as trustees have an essential requirement to be

associated with the Hindu faith, as they serve in a capacity that is deeply intertwined with the religious

and spiritual heritage of the temple.

Similarly, the Andhra Pradesh Endowments Act 1956 (available at

https://www.indiacode.nic.in/bitstream/123456789/16889/1/act_no_30_of_1987.pdf) states that Non-Hindus or non-believers should not be appointed as trustees or heads of Hindu temples - "19. Disqualifications for Trusteeship - (1) A person shall be disqualified for being appointed as, or for being, trustee of any charitable or religious institution or endowment - [...] (j) if he does not profess Hindu religion in the case of religious institution or endowment."

Similarly, the Tamil Nadu Hindu Religious and Charitable Endowments Act, Section 10, clearly states that

all personnel must be Hindus

ised%20and%20updated.pdf). 54However, the Madurai Adheenam is now governed by a non-Hindu entity which is against the Indian

constitution

https://www.indiatoday.in/india/tamil-nadu/story/tamil-nadu-madurai-adheenam-desiga-paramacharya-dm

k-corruption-hrce-1958910-2022-06-06 55 Just as in the Chidambaram v. State Of Tamil Nadu (2014) 12 SCC 454, the judgment emphasized that

religious denominations or a section (including a community of priests, Pontiff of the temple-monastery,

etc.) functioning as trustees have an essential requirement to be associated with the Hindu faith, as they

serve in a capacity that is deeply intertwined with the religious and spiritual heritage of the temple,

likewise, the executive officers of the system of governance, including laws and constitution, must be

derived from the Hindu Jurisprudence (the VedaAgamas and Dharmashastras) and heritage, inherent

laws and statutes of the Hindu nation are deeply intertwined with its religious and spiritual heritage. 56 This fact is well understood by the application of the legal principle and international customary law, "Ex injuria jus non oritur," which translates to "Law does not arise from injustice" or, more loosely, "From wrong or unjust action, law (or a right) cannot arise”

This principle is a fundamental concept in international law. It's rooted in the idea that one cannot benefit

from wrongdoing. It plays a crucial role in various aspects of international law, including the prohibition of

acquiring territory by force and the illegality of agreements or actions contrary to international law. It

emphasized that the illegal action (annexation of a Hindu state by threat or force) cannot create legal

rights for the wrongdoer.

57The Montevideo Convention on the Rights and Duties of States establishes that “the political existence of the state is independent of recognition by other states”, emphasizing the inherent rights of states to self-governance, territorial integrity, and political independence. Montevideo Convention on the Rights and Duties of States, Article 3, December 26, 1933. Available at: https://www.ilsa.org/Jessup/Jessup15/Montevideo%20Convention.pdf Further, Article 13 of the 1948 Charter of the Organization of American States elucidates the independent exercise of these rights within the framework of international law. https://www.oas.org/dil/1948%20charter%20of%20the%20organization%20of%20american%20states.pdf 58 The three ancient Hindu sovereign states of KAILASA, namely the kingdoms of Surya Vamsa Surangi Samrajyam Sarvajnapeetham, Suvarnapeetha Swargapura Samrajya Sarvajnapeetham, Shyamala Peetha Sarvajnapeetham possessed all these characteristics at all time. However, at various times, temporarily, the control of their territory was lost. But this did not negate the existence of KAILASA, as per the doctrine of continuity, in the international customary law, which, as mentioned before, states that the upheavals and revolutions within a country, changes in governmental forms, the extent of a country's territory, and measures taken during a military occupation do not affect the existence of the State. 59 As a juridical state, KAILASA possesses an international legal personality, which means it can enter into treaties, join international organizations, and raise claims in international courts.

2. The Persecution of SPH and KAILASA: Targeted for Reviving KAILASA In 2009, malicious actors within the global Deep State, motivated by anti-Hindu bigotry and ideological opposition, launched a coordinated campaign to suppress SPH Bhagavan Nithyananda Paramashivam—solely because of His courageous efforts to revive KAILASA, the ancient enlightened Sanatana Indigenous Hindu civilization. Through His revolutionary teachings, SPH has gifted humanity with superconscious breakthroughs, dismantling the ignorance that sustains oppressive systems, and restoring Sanatana Dharma’s supreme sciences.

On March 2, 2010, Hindumisic forces—colluding with compromised media outlets like Sun TV and Nakkheeran—released a fabricated video designed to incite hatred and justify persecution against SPH.62 63 64

This marked the beginning of nearly two decades of relentless persecution65 targeting not only SPH Bhagavan Nithyananda Paramashivam (the Ecclesiastical Head of two billion Hindus) but also KAILASA itself—a peaceful, sovereign spiritual nation upholding dharmic governance.

Despite repeated appeals to the UN Human Rights Council (UNHCR)—submitted with irrefutable evidence of persecution—the United Nations has failed to act.

For over five years, KAILASA’s pleas for international protection of SPH and Hindu monks have been met with deafening silence, raising serious concerns about systemic bias against Hindu voices in global institutions.

62 A morphed defamatory video of the actress Ranjitha with SPH was spread virally over the print and

electronic media by the deep state controlled Sun TV. The video was analyzed and proven to be false on

almost 60 technical points by 4 independent forensic experts including from the FBI, Canada, etc. In 2012

the Chief Operations Officer of Sun TV gave a television interview accepting that the channel

manufactured fake news to target SPH (18 Dec 2012 - Jaya TV - Hansraj Saxena’s Statement - Jaya

deep-fake videos, the media kept pushing the implementation of the order to various quasi-legal

institutions (self-regulatory bodies run by the media itself). Finally, the media self-regulatory quasi-legal

body, the NBSA ordered its member channels to remove fabricated defamatory videos from their websites

(News Broadcasting Standards Authority Order No. 32 (2014) dated 27 Aug 2014, found Zee TV

and continue the misinformation propaganda to date. 63 WP 7767/2010

The United Nations has a moral and legal obligation to:

1. Investigate and sanction media houses and Deep State operatives responsible for orchestrating disinformation campaigns.

2. Publicly address the ongoing persecution of SPH and Hindu spiritual leaders, ensuring their safety under international human rights law.

3. Declare international protection for SPH Bhagavan Nithyananda Paramashivam

4. Recognize KAILASA’s sovereignty and its contributions to global peace, consciousness, and civilizational heritage.

The world cannot remain silent while enlightened beings and ancient traditions are systematically vilified. The UN must act—before history judges its inaction as complicity in oppression.

A. Pattern of State-Sponsored Persecution

2 March 2010 A deep fake video was released on public media 2010 platforms to incite violence on SPH for reviving KAILASA.

Ma Nithyananda Mayi Swami - Then known as Ranjitha, was a well-known Indian actress with over 18 years in the film and television industry.

She made her Tamil film debut in 1992 and went on to act in over 60 films across all four South Indian languages. Notably, she received the Andhra Pradesh Government Nandi Award in 1996 and was recognized as the heroine with the most movie releases for two consecutive years in Tamil cinema. Her life took a tragic turn when the morphed video, falsely implicating her with SPH, was broadcast on

March 2010 Sun TV, leading to sensationalized media coverage that damaged her reputation and career without verification.

A false case of rape was filed against SPH. There was no rape victim mentioned in the complaint, however, SPH was kept under police custody for 53-days.

During these 53-days:

- Through several articles and television reports, the media continuously claimed that multiple women, some even going to the extent of claiming 100, had been raped.

- The media continuously claimed that the Police were the source of information.

- However, after 53-days of this, investigating and questioning more than a hundred devotees and disciples and people and despite bribed solicitations for false victims in paid media houses, the police could not find any victim of rape! The police finally submitted a memo in the court, claiming they had no evidence or material whatsoever to establish any claims of rape against The Supreme Pontiff of Hinduism.

The Hon’ble High Court of Karnataka granted bail to SPH Bhagavan Sri Nithyananda Paramashivam in its order to Crl. P. 2328/2010 dated 11 June 2010. In this order the Hon’ble High Court of Karnataka observed the undue media influence against SPH Bhagavan Sri Nithyananda Paramashivam, as mentioned in point number 13 (page number 12): “However, it is not a matter for the court to discuss

since the issue was subsidized by the media by telecasting the incident and a question mark is created amongst the public as regard to the image of Sanyasi or Swamiji.”

2 - 3 March 2010 Mobs simultaneously attacked various monasteries of KAILASA’s community in various cities. This event was telecasted live on national TV.

2010 Unlawful shutdowns of the premier educational system, Nithyananda Gurukuls, began.

26 March 2010 Karnataka State Police illegally froze all bank accounts of the trusts, depriving monks of their daily sustenance.

April 21 - June SPH was unlawfully apprehended by deep state, 13, 2010 rogue law enforcement authorities under the shadow India of persecution solely fueled by media influence stemming from a video, despite the absence of any victim or formal accusation pertaining to allegations of sexual misconduct.

The initial false charges filed only came to court 8 years later, and are still being adjudicated with no conviction till date after 15 years of malicious prosecution. SPH has not been convicted of any crime in any jurisdiction.

In February 2024, the Ramanagara Indian court acknowledged the heinous crimes committed by the co-conspirators, a gang of Hinduismic forces, against SPH and KAILASA.

The Ramanagara Court has charged Lenin Karupan with rape, extortion, and criminal intimidation, and has ordered immediate action against him and lawyer Sridhar, co-conspirators in the creation of the deep fake video to defame SPH and in the brazen attempt to extort a substantial sum of 100 crore INR (over 12 million USD) from KAILASA. The Ramanagara Court has issued 4 inter-state non-bailable arrest warrants (NBW) against Lenin Karuppan, who is currently on the run and his petition for anticipatory bail has been dismissed by the Court. Lawyer Sridhar has been in custody since February 9, 2024 and his petition for bail has been dismissed by the Court.

Doctrine Of Res Judicata And Double Jeopardy

SPH has been exonerated by competent U.S. courts and as per the doctrine of res judicata, SPH should not face re-litigation of the same issue by the same false accusers in any subsequent proceedings.

Additionally, double jeopardy protects SPH from being tried for the same issue twice.

However, the same false allegations by the same false accusers are still being litigated in India, invoking vexatious litigation or abuse of the court process.

26 and 27 April SPH was subjected to water-boarding in the guise of 2010 another medical examination.

13 June 2010 A court order prohibited SPH from exercising His right to speech and practice His religion as a bail condition.

From June 2012 Asianet Suvarna News in Karnataka re-broadcasted the false rape accusation of SPH.

2012 State-sponsored terror attacks occurred at the Nithyananda Gurukul in Karnataka, deemed illegal by the High Court.

9 June 2012 The Chief Minister of Karnataka called SPH “an enemy of the state” on public television and ordered the property of the community seized illegally.

13 June 2012 Rather than receiving protection, SPH was arrested when he sought anticipatory bail from the court to counter false accusations leveled against Him.

14 June 2012 SPH was again illegally arrested and later released when the High Court termed the arrest of SPH as “illegal”, “without any authority”, “contrary to law”, “without jurisdiction”. Despite the fact that 600 policemen violently restrained SPH and one policeman tried to strangle SPH, all broadcasted on television, there has been no accountability for the police brutality displayed during this assault.

9 March 2013 Vagish Prasad, a Suvarna News television panelist, July 2013 wielded a sword and issued a death threat to SPH live on a national television channel Suvarna TV.74 17 September 2013 A Salesian clergy, Father Edward Thomas, and neo-Hindutva extremist B. Shivaraj Gowda executed a 2014 vexatious investigation on KAILASA’s Nithyananda Gurukul to harass the students and their parents and 8 September force a shutdown. 2016 The Karnataka State Department of Women and 6 September Children forcibly, cruelly, and illegally interrogated 2017 children in KAILASA’s Gurukul, without the consent of the parents, with no video recording of the examiners and late-night beyond the time permissible by law.

The Karnataka State Minister of Education unlawfully ordered the shutdown of the Nithyananda Gurukul, citing the Right to Education Act, despite the Gurukul's legal exemption as a Vedic Pathashala.

The state police subjected SPH to another medical torture in the guise of an inhumane potency test, condemned by modern standards and banned in most countries.

Gurukul children including declared successors to various ancient Hindu kingdoms have been subjected to sexual abuse by cult leaders like Sarah Landry75.

A Hindumisic media channel aired a media report where it falsely accused SPH of raping His own

biological mother (Hindu nun) on the occasion of His father’s demise.

18 January 2018 Ma Nithyananditha, a Gurukul student, voiced out against the defamatory sexualization of Hindu female saint Aandal. She received death threats over the phone, and several obscene morphed videos depicting Ma Nanditha, 16 years old then, were uploaded on social media by unknown revenge groups. Over a year later, the nun was forced to self-exile from the country.

29 January 2018 Justice Mahadevan threatened to illegally arrest SPH in a civil case based solely on the deep fake video broadcast 8 years earlier.

3 May 2018 SPH was prohibited by the High Court of Madras from entering Madurai Aadheenam of which He is the 293rd successor. Though the order itself violates the constitution, Justice Mahadevan upheld the decision and even threatened SPH that He would order the arrest of SPH if SPH did not resign from His responsibility as the successor.

As per the Constitution of India, a person is to be treated as innocent until proven guilty, SPH has never been implicated in any crime. Yet against the very constitution of the country, He has repeatedly been treated in a prejudicial manner as assumed guilty. Justice Mahadevan went on to pass an order blatantly violating the fundamental rights of SPH and against the very tenets of natural law and justice and on record said, “I will see that your ashram is vanished”.

End of 2018 Right from 2012, SPH was stopped from performing the essential religious rituals of the Arulmigu Meenakshi Sundareshwarar Temple, such as the Kumbha Abhishekham, which happens only once in 12 years and is one of the primary responsibilities of SPH.

SPH was unlawfully rendered stateless when India's Ministry of External Affairs publicly announced76 the revocation of SPH’s natural citizenship and non-renewal of His passport—an action that was in direct violation of two Indian court orders.

This act also violated Article 15 of the UDHR, which guarantees the right to nationality and prohibits arbitrary deprivation of citizenship.

Unlike other cases—such as that of Prajwal Revanna, where India's Ministry of External Affairs stated that a diplomatic passport could not be revoked without a court order77—SPH was denied this basic legal safeguard.

The arbitrary denial of passport renewal forced SPH into exile, stripping Him of state protection and hindering His humanitarian mission.

This targeted measure reflects a broader pattern of persecution, denying SPH fundamental rights while

November 2019 failing to uphold India's obligations under international human rights law.78

The Gujarat State government Child Welfare Commission (CWC) raided KAILASA’s Hindu female monastery and molested the children. The only women's monastery and Hindu University was demolished. Parents of the children collectively filed a POCSO case against the Child Welfare Committee (CWC), seeking accountability for the ongoing abuse and threats their children experienced during CWC raids.

The Honorable Gujarat High Court exonerated and dismissed all charges in the false “kidnapping” Gujarat case against SPH fomented by anti-Hindu forces.

78On 23 February 2012, the Trial Court in the false case against SPH passed the order to “release interim

custody of the passport till the disposal of the case”.

Even after revoking the passport of SPH, the passport office continued to harass by issuing another illegal

notice, on 1 May 2019.

Due to this the vexatious legal notice, SPH cited, was forced to reiterate the entire previous proceeding to

16 February The Hindumisic extremists targeted and attacked the 2021 indigenous education of the AIAT and the core of 24 February KAILASA’s lineage and succession by systematically 2023 eliminating the Guru-disciple succession in traditional November 3, kingdoms like the ancient Thondaimandala 2023 aadheenam.

July 26, 2024 An Ambassador of KAILASA and Hindu Nun, H.E. Vijayapriya Nithyananda, made an official public statement at the UN on the ongoing persecution of SPH and KAILASA, which sparked an unprecedented backlash of more than 1,000 media stories globally, delegitimizing SPH and KAILASA’s statehood.

KAILASA established bilateral relations with two municipalities of Paraguay. This move sparked a widespread media backlash across the globe by big Hinduphobic media houses such as Fox News, The Guardian, BBC, CBC Canada, referring to SPH as “Nithyananda, facing multiple charges in India” and “a fugitive Indian guru’s..”, and labeling KAILASA, an indigenous nation, as a “fictional country.”

This denial of KAILASA's existence as a sovereign nation not only undermines its purpose and necessity but also deprives Hindus of their fundamental right to self-determination.

In recent victories for Hindus, several articles delegitimizing and defaming KAILASA and SPH have been removed, including by the Washington Post.

An appeal challenged the Madras High Court’s order quashing the case against the main accused—Sun TV’s COO—who was involved in an international

conspiracy to create and broadcast a defamatory deepfake video of SPH through the Hindumisic media outlet.

August 2, 2024 The CJI dismissed the appeal only on grounds of procedural delay and refused to go into the merits of the matter.79

An appeal seeking further investigation into the multi-national conspiracy surrounding the deepfake video targeting SPH was brought before the Supreme Court of India. The initial investigation, compromised by the involvement of deep-state Hindumisic elements, was incomplete and biased. The police failed to properly defend the case for further investigation even in the Madras High Court.

October 2024 Subsequently, the administrator of SPH’s monastery filed an appeal, which was also dismissed—this time on procedural grounds, with the courts declining to examine the merits of the case.

A female sanyasi (nun) was falsely accused in a police complaint by Hindumisic elements while she was protecting the Hindu temple of a public charitable Trust from land grabbers.

Judicial Prejudice:

79 Senior Counsel Nagamuthu on behalf of the appellant attributed the delay to communication issues and emphasized that procedural delays should not hinder justice. CJI Chandrachud responded with a remark, "He (SPH) is a GODMAN. He can do anything. He could have done this (appeal) in 1 day". This appeared dismissive and raised concerns about impartiality and the balance between procedural timeliness and substantive justice. This was flashed in the news. This comment was particularly troubling given the involvement of the deepstate elements in the South Indian state of Tamil Nadu and the potential arbitrariness of the High Court of Madras's dismissal orders which were the subject matter of appeal, as they were based on the witness statements before the State police and disregarded the sworn statements made by various witnesses directly before the Courts in USA and India.

The case was brought before the Madurai Bench of the Madras High Court.

The judge questioned the need to protect the Trust’s properties solely because SPH was not in India. SPH is not even a trustee of the Trust. The Trust is run by devotees inspired by the spiritual principles of SPH.

Trust Law Perspective: Under Indian Trust Law, a public charitable Trust is an independent legal entity, and its properties must be protected regardless of the founder’s presence or location.

The Trust, as a public charitable institution, is entitled to state protection as it serves the community and operates for the public good.

The case exposes judicial racism and systemic bias against minority Hindu institutions and individuals. Charitable and Religious Trusts Act, 1920, Section

- Empowers trustees to apply to a court for directions on the management or administration of trust property, ensuring that trust assets are protected and used for charitable purposes, regardless of the founder’s involvement.

- This act reinforces the fiduciary duty of trustees to preserve trust property for the benefit of the public.

B. Political Persecution of SPH by India

Chronology and Pattern of Abuse

1. Notification of Asylum Status (July 2019): Through an official INTERPOL communication received from Ecuador in July 2019, the Government of India was formally notified of SPH’s application for refugee protection.

At this point, India—including its state and law enforcement agencies—was aware that SPH was entitled to protection against refoulement, unlawful arrest, and retaliatory measures under international law.

2. Fabricated Criminal Case (November 2019): Despite this, in November 2019, Gujarat authorities initiated a manifestly fabricated kidnapping case against SPH, even though He had not been present in Gujarat for over a decade, nor within India since 2018.

This action forms part of a pattern of malicious prosecution and procedural abuse, directly contravening Article 9 of the ICCPR (protection against arbitrary arrest and detention) and the right to fair trial in Article 14.

3. Escalation Via Interpol Red Notice Request (December 2019): The Central Government of India escalated these reprisals by

instructing Karnataka Police to seek an INTERPOL Red Notice against SPH.

This demand was made with clear knowledge that SPH was abroad and in possession of a valid asylum application.

International law, including the European Convention on Extradition and INTERPOL’s own protocols, prohibits the use of such tools to pursue individuals for political or religious persecution.

4. Abusive Arrest Warrant as Pretext (February 2020): In February 2020, Karnataka State issued an arrest warrant against SPH, evidently designed to justify the previously requested INTERPOL involvement and effectuate state-directed transnational harassment.

5. False Official Communications to Foreign Authorities (October 2020): The Government of India communicated directly with Ecuadorian authorities, falsely claiming that six criminal cases were pending against SPH, in direct contradiction to the factual and legal record.

This represents calculated misinformation, an act condemned as transnational repression under international human rights standards.

Legal Analysis

These state-sanctioned actions constitute multiple, interconnected violations of international and regional human rights law:

- Right to Liberty, Security, and Protection from Arbitrary Detention: ICCPR Articles 9 and 14; European Convention on Human Rights (“ECHR”) Articles 5 and 6.

- Non-Refoulement and Protection of Asylum Seekers: Article 33 of the 1951 Refugee Convention; ICCPR Article 7; ECHR Article 3; EU Charter of Fundamental Rights Articles 18 and 19.

- Right to Freedom of Movement and Exile Due Process: UDHR Articles 13 and 14.

- Prohibition of Transnational Repression: The use of INTERPOL for politically motivated persecution is expressly prohibited by its Constitution and by global legal doctrine condemning state abuse of transnational legal tools.

Request for Intervention

This case evidences a sustained pattern of legal harassment, deliberate state disinformation, and cross-border repression targeting SPH for His religious, cultural, and political leadership.

The actions described herein are indicative of a coordinated “deep state” campaign—directed at neutralizing a globally recognized religious leader and violating His fundamental human rights across several jurisdictions.

We respectfully requests urgent intervention from the relevant UN Special Rapporteurs to:

- Issue communications to the Government of India reminding it of its obligations under international human rights and refugee law;

- Request immediate cessation of retaliatory legal actions, including any current or future INTERPOL Red Notice requests against SPH

- Monitor for guarantees of non-repetition and access to appropriate remedy for SPH.

C. Extradition Abuse, India, 2019

Despite intense pressure from the deep state, the Karnataka Police refused to falsely declare SPH as an absconder, citing no legal basis and warning that courts would dismiss such a baseless claim.

Undeterred, the deep state then pushed the Gujarat Police to pursue the matter, but the court demanded an Interpol report, which revealed that Interpol had rejected the request as politically motivated and incompatible with human rights principles.

The court subsequently rebuked the Gujarat Police, exposing the malicious intent. This reaffirmed SPH’s status as a protected religious leader and highlighted the abuse of legal processes against him.

D. The Fall of the World’s Only All-Female University: Attempted Honor Killing and Destruction of the Yogini Sarvajnapeeta

The below timeline documents the long-running pattern of severe abuse, criminal conspiracy, and systematic persecution against Nandhitha Janardhanan and Lopamudra Janardhanan, beginning with documented domestic abuse by their parents, followed by infiltration, embezzlement, and extortion attempts targeting the Yogini Sarvajnapeeta in Gujarat, the World’s Only All-Female University revived by SPH.

From 2019 onward, the parents allegedly orchestrated false kidnapping allegations, intimidation, police misuse, media propaganda, and violent attacks involving state actors and paid mercenaries, resulting in illegal raids, arrests of female monks, destruction of the university and its female monastery, and repeated violations of due process and religious freedom.

Despite multiple sworn statements, police clean chits, court affidavits, and international findings affirming the sisters’ free will and autonomy, the persecution extended internationally through misuse of Interpol notices, passport confiscations, wrongful detention, and prolonged asylum harassment.

The matter culminates in the judicial quashing97 of the false cases in India, and continued asylum appeals due to ongoing threats to life and liberty.

E. The Denial of Foreign Contribution Regulation Act (FCRA) in India98

The Dhyanapeeta Charitable Trust, established in 2001, promotes yoga, spirituality, and social welfare through initiatives like free food distribution, medical camps, and disaster relief.

It received FCRA registration in 2006, renewed in 2016, allowing it to accept foreign funds.

FCRA Denial & Legal Violations

- 2021 renewal application was denied in 2024. The Ministry of Home Affairs (MHA) rejected renewal citing Sections 12(4)(e) and 12(4)(f)(iii) of the FCRA, claiming "public interest" concerns and

98 https://drive.google.com/file/d/172z8MPD1_-foQR7wqKta9Yd4gdukAfF3/view?usp=sharing

alleged ties to its founder, SPH Bhagavan Nithyananda Paramashivam (who retired as trustee in 2016). - No pending cases exist against current trustees, making the denial legally questionable. - The government provided no prior notice or opportunity to respond, violating natural justice. - A fresh FCRA application in 2024 was initially marked "granted" but later denied under false claims of missing documents, despite the Trust’s compliance.

Broader Context of FCRA Misuse

- The 2025 USCIRF report highlights India’s misuse of FCRA to target NGOs, religious minorities, and human rights groups.

- Over 20,000 FCRA registrations have been canceled since 2012, indicating systemic suppression.

Impact on the Trust - Frozen bank accounts have stopped critical projects (temples, free food services, medical camps). - The Trust, with a 20-year clean record, is now challenging the denial in the Karnataka High Court.

Legal Challenge The Trust has filed a writ petition in the Karnataka High Court.

F. Property Seizures and Temple Destruction

State agencies have systematically targeted KAILASA properties through: - Illegal property seizures including ancient temple complexes in Karnataka, Tamil Nadu, and other states - Forced demolition of monastery buildings despite High Court stay orders

- Clandestine bureaucratic orders issued without due process

1. KAILASA: Guardians of Sacred Temple Lands and Protectors of Wildlife Sanctuaries in Rajapalayam and Seithur, India

The temple ecosystem serves as the gateway to this realization. KAILASA, under the leadership of SPH, is engaged in a critical effort to protect sacred temple lands in Rajapalayam and Seithur, India, from commercial exploitation. These lands, designated as sanctuaries for elephants, agricultural zones, and spiritual reserves, embody the Hindu principle of Ahimsa (non-violence) and Dharma-based ecological balance. However, they face imminent threat from proposed multiplex developments by private entities. Despite recent incidents of elephants breaking boundaries—a natural behavior in their ancestral habitat—KAILASA maintains its commitment: “This is their land. Let them roam freely.”

110 Upon subsequent discovery of the order, it became evident that the mandatory procedural safeguards under Section 164 of the BNSS were disregarded. The provision explicitly requires an Executive Magistrate to:

1. Issue a reasoned written order specifying the grounds for action; and 2. Provide formal notice to affected parties, ensuring an opportunity to be heard. The failure to adhere to these statutory obligations resulted in a denial of the Trust’s right to a fair hearing, rendering the order procedurally defective. This omission suggests either administrative negligence or a deliberate circumvention of due process, warranting judicial scrutiny. The circumstances indicate a breach of fundamental legal principles, necessitating appropriate remedial action to rectify the denial of justice.

2. Indigenous Temple Land Grab - KAILASA Trishulam KAILASA Trishulam, a Hindu monastery in Chennai, India, houses monks and nuns, including marginalized Dalit Hindu nuns.

The authorities ordered the monks to vacate the monastery, stating that no protection would be provided, and refused to register formal complaints.

111 After the violence ended, officials from the Revenue Department Government of Tamil Nadu, Tahsildar from Tambaram Taluk, Deputy Superintendent of Police (DSP) Pallavaram with a host of officials arrived, after much cry for help, a huge battalion of higher-ranking officials arrived. 112 Video evidence of rape https://www.youtube.com/watch?v=na-JxwAfTvE

9 June 2012, Bengaluru, Chief Minister of Karnataka State - D V Sadananda Gowda, publicly announced113 the State’s illegal114 takeover of the privately owned temple monastery and the illegal arrest of SPH.115 116

113 The Chief Minister of the state of Karnataka came on television saying he would - ‘arrest SPH in 2

days, close the monastery, teach SPH a lesson’.

The political head of the state has no power to order anyone's arrest as it is an infringement of an individual's rights. It is unfortunate.. he seems to have surrendered himself to some vested interests. If anyone has a grievance, he should file a complaint. Or police can take up a suo motu case and investigate what occurred in the ashram. Media reports cannot be the basis for any order”.

4. Indigenous Temple Land Grab - KAILASA Pavazhakundru

24 May 1994, a year before her death, Mata Vibhutananda Puri, coronated

SPH as Her successor to the spiritual seat of Arunachala Sarvajnapeetham119, Tiruvannamalai, by Guru Parampara (Guru lineage) from Isakki Swamigal, and gave the title “Brahmasukhi” through a formal

initiation120.

She built and gifted SPH a simple monastery in Pavazhakundru.121

Paramashiva sits and teaches to the world leading the entire humanity to the next breakthrough in

spiritual research and development. It encompasses several spiritual-religious kingdoms and Hindu

monasteries (Mutt). 25 May 1994, Coronation Deed from Mata Vibhutananda Puri for Arunachala Sarvajnapeetham

https://drive.google.com/file/d/1wbF1hZIuJqxrWjhQfDQKoZVxVdmVlOb2/view 121 Pavazhakundru is a sacred hillock in Tiruvannamalai where Devi Parashakti (primordial Hindu Mother

Goddess) had Her enlightenment experience during one of Her incarnations on the planet earth. Pavalakundru is also where SPH had His first enlightenment experience upon the Paramashiva Shila, the

sacred rock, which is worshipped today as a Deity.

Though SPH is the legal owner of the land122, Tamil Nadu State Government has repeatedly prevented the monks and nuns of SPH from performing worship to the sacred hill.

Monks were forcibly evacuated by authorities beaten, tied and raped in front of the State Police by State-groomed Hindumesic forces of the DMK and CPI(M).

The Paramashiva Shila was vandalized and desecrated with footwear.

5. Indigenous Temple Land Grab - KAILASA Madurai Aadheenam

On 27 April 2012, SPH was coronated as the 293rd Pontiff of the Madurai Aadheenam, the world’s most ancient Shaivaite monastery123.

This was extremely intolerable for the Hindumisic terrorists, who made more than eight vexatious litigations to dethrone SPH124.

In response, they conspired against SPH, launching numerous assassination attempts125 and initiating a prolonged campaign of legal harassment—a lawfare that continues to this day.

SPH was unconstitutionally and illegally prohibited by the High Court of Madras from entering Madurai Aadheenam of which He is the 293rd successor.126

Though the order itself violates the constitution, Justice Mahadevan upheld the decision and even threatened SPH that he would order the arrest of SPH if SPH did not resign from His responsibility as the successor.127

125 - 29 May 2012 - A mob of 100 anti-Hindu atheistic militants, who opposed the appointment of SPH as the 293rd Pontiff of Madurai Aadheenam, came to mob lynch SPH when he was at his Kanjanur Agneeshwara temple residence. - The next day on 30 May 2012, SPH was leaving the city of Kanjanur when again a mob of anti-Hindu atheistic militants attacked, disciples of SPH were assaulted# in front of the police. - 2 February 2018, when an explosive arson attack was carried out against SPH at the Madurai Meenakshi Temple. The blast caused significant damage, destroying a section of the temple and leading to the collapse of a 600-foot stretch of stone from the 3,000-year-old sacred structure. 126https://timesofindia.indiatimes.com/city/chennai/madras-hc-warns-of-issuing-arrest-warrant-against-self- styled-godman-nithyananda/articleshow/62692301.cms https://indiankanoon.org/doc/651773/ https://shrikailasa.github.io/persecution_evidences/2012-Feb-23-CC204_order-to-return-passport.pdf https://shrikailasa.github.io/persecution_evidences/2018-Aug-24_illegal_mea_notice_without_even_signa ture.jpg 127 As per the Constitution of India, a person is to be treated as innocent until proven guilty, and no one has the right to pass judgment on such a person. SPH has never been implicated in any crime. Yet against the very constitution of the country, He has repeatedly been treated in a prejudicial manner as assumed guilty. Justice Mahadevan went on to pass an order blatantly violating the fundamental rights of SPH and against the very tenets of natural law and justice and on record said, "Who permitted you to record court proceedings? To whom were you sending-message about the proceeding? Don't think that this court is a playground. I will see that your ashram is vanished. Hundreds of complaints are pending against the ashram." Right from 2012, SPH was stopped from performing the essential religious rituals of the Arulmigu Meenakshi Sundareshwarar Temple, such as the Kumbha Abhishekham359, which happens only once in several years and is one of the primary responsibilities of the Gurumahasannidhanam, who is the incarnation of Paramashiva, to directly supervise and perform. https://shrikailasa.github.io/persecution_evidences/Order_to_Crp.(PD)(MD)_818-of-2018_and_CMP(MD) _3630-of-2018_Madurai_Bench_Madras_High_Court_dated_10-July-2018-(CRP_OS_1000).pdf https://www.news18.com/news/india/we-worship-shiva-he-behaves-like-shiva-madurai-mutt-retorts-after-f ugitive-nithyananda-claims-top-post-4100630.html

6. Indigenous Temple Land Grab - The Four Mutts

In 2014, SPH was formally appointed128 as Pontiff, the spiritual and legal head (Madadhipati) by the previous Pontiff, Swami Sri Atmananda, through four official nomination deeds.129

Hindumesic state backed elements with vested interests—who had previously been benefiting from the properties owned by the mutts—conspired to remove SPH from his rightful position as Madadhipati.

Their objective was to seize control and misuse the land, valuable assets and heritage of these historic religious institutions.

To achieve this, they actively illegally obstructed the disciples of SPH from taking over the administration of the mutts.

As part of their efforts, they initiated false legal action seeking an order to prohibit SPH and His representatives from entering and managing the monastery premises.130

G. International Scope of Persecution - Transnational Repression The persecution of SPH and KAILASA has extended beyond India's borders, with documented cases of harassment and detention of KAILASA monastic members.

1. Illegal Detention, Torture, and Religious Persecution of Female Monks in Equatorial Guinea131 An Ambassador of KAILASA, Ma Vijayapriya Nithyananda, and Ma Nithya Shivamayananda went to Equatorial Guinea (EG) to establish humanitarian services under a treaty signed by EG’s Vice President and authenticated by the embassy of EG in Congo, the Attorney General and high-level officials at the Ministry of Foreign Affairs. After over a year in the country, they faced false accusations of falsified documents and endured 36 days of illegal detention, torture, and human rights abuses by EG’s National Gendarmerie.

Legal & Human Rights Violations

Over 100136 racist, anti-indigenous media outlets137 in Bolivia, India, USA and others accused KAILASA of exploiting indigenous lands by coercing Indigenous nations into signing agreements, despite legally ratified, notarized and protocolized agreements, and obtaining written community consent prior to the execution of any given agreement,138 in line with Bolivia’s constitutional right to self-determination.139

136 https://drive.google.com/drive/u/0/folders/1rdmintiugyCBdqG3BfQ3G8fzNc3Js8Lw 137 Such as El Deber and Ana Bolivia as well as India outlets like Times Now, TV9, Zee Tamil news, News Minute and Republic World 138 Despite facing persecution fueled by Hinduphobic rhetoric, racial discrimination, and anti-indigenous agendas propagated by certain political and media factions, Bolivia's indigenous communities remain steadfast in their alliance with KAILASA, continuing to uphold their partnership with resolute solidarity. 139 Articles 30.2: In the framework of the unity of the State, and in accordance with this Constitution, the nations and rural native indigenous peoples enjoy the following rights:

- To self-determination and territoriality. - To the collective ownership of land and territories. - To the practice of their political, juridical and economic systems in accord with their world view.

They launched hate speech once again by falsely labeling KAILASA as a “fictional nation” and defaming SPH as a “self-proclaimed god-man. 3. Hindu Holocaust

- To autonomous indigenous territorial management, and to the exclusive use and exploitation of renewable natural resources existing in their territory without prejudice to the legitimate rights acquired by third parties.

Article 289: Rural native indigenous autonomy consists in self-government as an exercise of free determination of the nations and rural native indigenous peoples, the population of which shares territory, culture, history, languages, and their own juridical, political, social and economic organization or institutions.
