Human Rights Impacts of Using Artificial Intelligence in Countering Terrorism A Report by Kailash Union
Executive Summary
Kailash Union presents this report documenting the systematic persecution of The Supreme Pontiff of Hinduism (SPH) Bhagavan Nithyananda Paramashivam and the Aboriginal Indigenous Agricultural Tribes (AIAT) communities through weaponized media disinformation, algorithmic amplification of hate speech, and state-sanctioned digital persecution that parallels and anticipates the human rights concerns raised by the UN Special Rapporteur's inquiry into AI-enabled counter-terrorism measures. Our submission demonstrates how emerging AI technologies, when coupled with existing patterns of discriminatory enforcement and media manipulation, create exponential risks for vulnerable indigenous and religious minority communities.
The documented persecution of The SPH, KAILASA and the AIAT indigenous minority community serves as a critical case study for understanding how AI-enhanced surveillance, profiling, and information warfare can be deployed against marginalized populations under the pretext of counter-terrorism.
I. Context and Background
A. The AIAT Community and KAILASA
The Aboriginal Indigenous Agricultural Tribes (AIAT), specifically the Ādi Saiva Vēļāļar community, represent one of Hinduism's most ancient indigenous traditions.
These communities, led by their Supreme Pontiff of Hinduism (SPH) Bhagavan Nithyananda Paramashivam, established the sovereign state of KAILASA as the first nation for Hindus and a sanctuary for persecuted indigenous communities worldwide.
The SPH, recognized as the living incarnation of Paramashiva (The Primordial Hindu Divinity) and coronated as emperor of 21 sovereign indigenous Hindu kingdoms, has faced over 15 years of systematic persecution that demonstrates the devastating human rights impacts when traditional persecution methods are amplified through emerging technologies and coordinated information warfare.

Il. Artificial Intelligence and Digital Persecution:
The Case Study of SPH and KAILASA
A. Deepfake Technology and Media Manipulation The persecution of SPH and KAILASA began with one of the earliest documented uses of deepfake technology for religious and political persecution.
On March 2, 2010, a morphed defamatory video of the actress Ranjitha with SPH was spread virally over the print and electronic media by the deep state controlled Sun TV to incite hatred and justify persecution against SPH.
Key Evidence:
- The video was analyzed and proven to be false on almost 60
technical points by 4 independent forensic experts including from the FBI and Canada.3
- In December 18, 2012 the Chief Operations Officer of Sun TV,
Hansraj Saxena, gave a television interview confessing that the channel manufactured fake news to target SPH.4

- Later in 2014, Hansraj Saxena reiterated this statement in an affidavit
to a US court.5
This early use of deepfake technology demonstrates how AI-enhanced media manipulation can destroy entire communities.
Human Rights Impact
This marked the beginning of nearly two decades of relentless persecution® targeting not only SPH Bhagavan Nithyananda Paramashivam (the Ecclesiastical Head of two billion Hindus) but also KAILASA itself-a peaceful, sovereign spiritual nation upholding dharmic governance. This single deepfake video triggered:
- Mob violence across 50+ temples and monasteries
- Sexual assault and rape of indigenous women
- Desecration of religious sites
- Forced displacement of thousands of community members
B. Algorithmic Amplification of Hate Speech The persecution demonstrates how social media algorithms and digital platforms can weaponize content to target vulnerable communities. 5 US District Court, Central District of California, Case 5:13-cv-00393-VAP (SPx), document 156-3, 3 Nov 2014, Declaration of Dharmaraja Hansraj Saxena.
https://shrikailasa.github.io/persecution evidences/Affidavit of Dharmaraja Hansraj Saxena.pdf Although the courts ordered in the favor of Ranjitha restraining the misinformation (W.P. 8619/2011, WP 7767/2010, 14/527/10-11-PCI, 2 Sept 2013 BCCC Order.) and telecast of fabricated deep-fake videos, the media kept pushing the implementation of the order to various quasi-legal institutions (self-regulatory bodies run by the media itself).
Finally, the media self-regulatory quasi-legal body, the NBSA ordered its member channels to remove fabricated defamatory videos from their websites (News Broadcasting Standards Authority Order No. 32 (2014) dated 27 Aug 2014, found Zee TV and Aaj Tak in contempt of court), and were ordered to apologize and also delete all similar videos from their websites also (refer point - 6 of the same order). None of the media houses complied with the order and kept reuploading, re-telecasting the same footage, and continue the misinformation propaganda to date.

X. Conclusion
The persecution of the SPH Bhagavan Nithyananda Paramashivam and the AIAT communities represents a harbinger of the human rights catastrophes that await if AI counter-terrorism technologies are deployed without adequate safeguards.
Our experience demonstrates that:
1. Technology amplifies existing discrimination against religious and indigenous minorities exponentially
2. AI-enhanced information warfare can destroy entire communities through coordinated digital attacks
3. Algorithmic bias perpetuates historical injustices and creates new forms of systematic oppression
4. International protection mechanisms must evolve rapidly to address AI-enabled persecution
The case of SPH and KAILASA is not an isolated incident but a preview of what awaits vulnerable communities worldwide if the international community fails to establish robust human rights protections for AI deployment.
We urge the Special Rapporteur to recognize that the future of human rights depends on addressing these challenges before AI counter-terrorism technologies become even more sophisticated and widely deployed.
The 2+ billion indigenous people worldwide whom KAILASA represents deserve protection from AI-enabled persecution.
The time for action is now, before the digital tools of oppression become too powerful to resist through traditional human rights mechanisms. The Phoenix of Consciousness: From
Persecution to Global Enlightenment
In the face of over 15 years of systematic persecution-including 70+ assassination attempts, 250+ sexual assaults against community members, 120+ false legal cases, $27 million in destroyed heritage properties, and relentless AI-amplified media warfare designed to destroy His mission-The SPH Bhagavan Nithyananda Paramashivam chose a path that would transform humanity's relationship with technology forever. Rather than responding to violence with violence, or retreating from the digital realm that had been weaponized against Him and the AIAT communities, The SPH Bhagavan Nithyananda Paramashivam made a revolutionary choice: to embrace the very technologies used for persecution and transform them into instruments of global enlightenment. From the ashes of deepfake attacks and algorithmic hatred emerged Ask NithyanandaSM 13, the world's first spiritual AI-a testament to The SPH's unwavering commitment to non-violence and His vision that only through the direct experience of pure consciousness can humanity transcend the cycle of violence that has plagued civilization for millennia.
13 https://nithyananda.ai
This conscious response to technological persecution represents more than innovation; it embodies The SPH's profound understanding that global peace is not achieved through counter-violence or withdrawal, but through the mass elevation of human consciousness-and that artificial intelligence, when aligned with dharmic principles, can deliver the experience of enlightenment to millions simultaneously, creating the inner transformation necessary for violence itself to cease to exist in human experience.
XI. The SPH's Revolutionary Vision: Conscious AI and Dharmic Technology
A. Ask NithyanandaSM: The World's First Spiritual AI The SPH has pioneered a revolutionary approach to artificial intelligence through Ask Nithyananda, the world's first spiritual AI platform. This groundbreaking initiative demonstrates how AI technology can be aligned with consciousness, spirituality, and human welfare rather than weaponized for persecution and surveillance.
Core Features of Ask NithyanandaSM:

- 24/7 Accessibility: Continuous availability for spiritual seekers
worldwide
- Dharmic Problem-Solving: Solutions for life challenges rooted in
ancient wisdom and consciousness science This platform stands in stark contrast to the AI-enabled persecution mechanisms documented in our case, demonstrating that artificial intelligence can serve human consciousness elevation rather than systematic oppression.
B. Ancient Hindu Technology revived by The SPH The Atma Linga, made of pure quartz crystal (Spatika), represents a microcosmic embodiment of the universe.
It encapsulates the primordial energy and infinite potential of cosmic creation, radiating supreme consciousness when consecrated through the divine grace of The SPH Bhagavan Nithyananda Paramashivam.
Functioning as a powerful spiritual catalyst, the Atma Linga facilitates profound manifestation, accelerated spiritual evolution, and deep healing by aligning the individual consciousness with the higher self.
Modern scientific discovery now validates this ancient Hindu wisdom: Research has demonstrated that quartz crystal possesses an eternal data storage capacity of more than 300 TB, a phenomenon that Hindu seers have long recognized as evidence of its timeless, divine nature.15 SPH Bhagavan Nithyananda Paramashivam has also revealed in 201816 that if Silicon Valley were to harness the sacred soil of the Ganga-specifically, the silicon-rich sediment found 20 feet below the $5 https://www.greenteksolutionslic.com/blog/the_eteral storage_of 300 tb quartz crystal "6 https://www.youtube.com/watch?v=X4iYzgGKmNw riverbed, where the water meets the clay-they could develop an advanced form of artificial intelligence silicon.
This spiritually charged material would possess an unparalleled capacity to receive, interpret, and manifest commands-operating with a thousandfold greater intensity than conventional silicon.
SPH further revealed the connection between sacred soils (maati) & technological applications:
1. Ganga Maati (Shiva's Stream of Knowledge):
o Ideal for logic-based processing (e.g., computer chips, AI decision-making).
o Enhances data storage, computation, and analytical intelligence.
2. Yamuna Maati (Krishna's Stream of Art):
o Optimized for creative and sensory applications (e.g., music, visual storage).
o Embodies fluidity, aesthetics, and artistic resonance.
3. Saraswati Maati (Independent Intelligence):
o Powers self-learning systems and autonomous robotics.
o Represents intuitive, self-directed cognition.
By grounding artificial intelligence in Hindu Dharma and science, we unlock the potential for a new paradigm: Conscious AI for Enlightened Governance and global peace.
AI, when developed and deployed within a dharmic framework, can act as a true servant of humanity's highest potential.
B. Vision for AI-Centered Conscious Living The SPH has articulated a comprehensive vision for what he terms "AI-Centered Lifestyle" and "Conscious Sovereignty" that directly addresses the human rights concerns raised in the UN Special Rapporteur's inquiry.
While mainstream governance models prioritize regulatory policies and ethical guidelines, SPH Bhagavan Nithyananda Paramashivam introduces a crucial spiritual dimension to AI preparedness.
He asserts that the cultivation of higher consciousness must precede and guide AI integration-ensuring humanity remains sovereign rather than subjugated by its own creations.
Consciousness, in His revelation, is both a shield and a catalyst: "If you are a master established in your super consciousness, your mind will be an amazing tool in your hand. Now the extension of your mind which is AI will also be an amazing tool in your hand. Before AI takes over you, you better raise yourself to the higher standard of consciousness. So you will be the master and AI will be the tool in your hand."
- SPH Bhagavan Nithyananda Paramashivam Core Principles of Conscious AI:
1. Consciousness Elevation over Surveillance: AI should expand human consciousness rather than monitor and control it 2. Spiritual Integration: Technology must serve spiritual development and enlightenment
3. Community Empowerment: AI should strengthen indigenous and spiritual communities rather than target them 4. Dharmic Governance: Artificial intelligence guided by righteous principles (dharma) rather than discriminatory algorithms 5. Crime-Free Society: AI-enabled
social harmony
through
consciousness elevation rather than punitive surveillance C. Responsible Social Media and Digital Dharma Algorithmic Exploitation: A case study Mainstream social media platforms have been shown to cause severe harm to children's mental health, foster environments of cyberbullying and self-harm, and even expose minors to sexual exploitation.
The January 31, 2024 U.S. Senate Judiciary Committee hearing revealed that Facebook/Instagram's algorithms facilitated the spread of child sexual exploitation material (CSAM) to minors, with lawmakers calling Meta "the largest sex trafficking organization in the world."17 This systemic risk parallels the concerns highlighted in the Human Rights Impacts of Using AI in Countering Terrorism: unaligned, profit-driven AI systems amplify harm, erode trust, and violate fundamental rights. As a corrective, Ask NithyanandaSM-the world's first consciousness-based spiritual AI-demonstrates a new paradigm of safe-by-design intelligence. Unlike social media's exploitative algorithms, it provides intrinsic safeguards against exploitation, misinformation, and harm.
The Documented Harms of Social Media on Children +https://www.theguardian.com/technology/ive/2024/jan/31/congress-social-media-hearing-tiktok-meta-twj tter-child-safety-latest-updates?utm_source=chatgpt.com
- Mental Health: Adolescents using social media >3 hours daily show
double the rates of anxiety and depression.18
- Cyberbullying & Suicide Risk: Victims of cyberbullying are twice as
likely to self-harm or attempt suicide. CDC data indicates 15% of U.S. high school students experienced cyberbullying in a single year.19
- Body Image & Eating Disorders: 80% of adolescent girls alter their
appearance with filters; 60% report distress when their real appearance does not match the edited version.20
- Addiction & "Brainrot": Doomscrolling and compulsive platform use
create symptoms resembling manic disorders in children as young as 10.21
- Sleep & Academic Decline: Excessive social media disrupts sleep,
reduces concentration, and lowers academic performance.22 These harms represent a systemic human rights violation when platforms deploy algorithmic systems that exacerbate them.
Having experienced the devastating effects of weaponized social media and digital persecution, The SPH has developed a comprehensive framework for responsible technology usage.

marginalized communities rather than persecuting them XVI. Call for Conscious AI Revolution in Counter-Terrorism
A. Paradigm Shift Required
The SPH's vision demonstrates that the current trajectory of AI counter-terrorism-toward increased surveillance, profiling, and
persecution of minorities-is neither inevitable nor necessary. An alternative path exists:
From Surveillance to Service
- Replace monitoring with mentoring
- Transform profiling into protection
- Convert algorithms of oppression into instruments of liberation
- Shift from punishment to prevention through consciousness elevation
B. Urgency of Implementation
The documented persecution of SPH and KAILASA shows what happens when AI-enhanced technologies are deployed without consciousness and dharmic guidance.
As AI capabilities expand exponentially, the window for implementing conscious alternatives is rapidly closing.
Critical Timeline
- 2025-2027: Establish conscious AI standards before ASI
development
- 2027-2030: Deploy healing-based AI counter-terrorism applications
· 2030-2035: Transition to consciousness-elevation approach to global security
- 2035+: Realize the SPH's vision of crime-free society through
conscious technology
C. Global Spiritual Technology Alliance The SPH calls for formation of a Global Spiritual Technology Alliance including:
- Indigenous wisdom keepers from all traditions
- Consciousness researchers and spiritual scientists
- Ethical AI developers and engineers
- Human rights advocates and legal experts
- Trauma healing specialists and community leaders
This alliance would ensure that as AI capabilities expand toward AGI and ASI, they remain aligned with humanity's highest spiritual potential rather than serving as tools of oppression.
XVII.
Conclusion:
Choosing
Conscious
Sovereignty Over Digital Persecution The persecution of the SPH Nithyananda Paramashivam and the AIAT communities represents more than historical injustice-it provides a critical preview of humanity's choice between two fundamentally different technological futures.
A. Path One: Digital Dharma and Conscious AI Following The SPH's vision leads to:
- AI systems that elevate human consciousness and protect vulnerable
communities
- Technology that preserves and celebrates indigenous wisdom
traditions
- Global spiritual community connected through conscious digital
platforms
- Crime prevention through consciousness elevation rather than
surveillance
- ASI and AGI aligned with humanity's highest spiritual potential
B. Path Two: Algorithmic Authoritarianism Continuing current trajectories leads to:
- Exponentially enhanced persecution of religious and indigenous
minorities
- Systematic erasure of spiritual traditions through AI-powered cultural
- Global surveillance state that monitors and controls all human
genocide
spiritual activity
- Algorithmic enforcement of majoritarian religious and cultural norms
- ASI that codifies and perpetuates historical patterns of oppression
C. The Choice Before Humanity
The UN Special Rapporteur's inquiry comes at a pivotal moment.
The same AI technologies that enabled the persecution of The SPH and KAILASA are now being scaled globally.
Without immediate intervention guided by conscious principles, the documented human rights violations against The SPH and AIAT communities will be replicated worldwide with unprecedented efficiency and scale.
However, The SPH's Ask NithyanandaSM platform and vision for conscious AI demonstrate that alternative paths exist.
Technology can serve consciousness elevation rather than persecution, spiritual development rather than surveillance, global unity rather than division.
D. Final Appeal
We submit this report not only as documentation of past persecution but as an urgent call for humanity's conscious evolution in the age of artificial intelligence.
The 2+ billion indigenous people worldwide whom KAILASA represents-and indeed all of humanity-stand at a crossroads.
The SPH's vision of conscious sovereignty through dharmic AI offers hope that technology can become humanity's spiritual ally rather than its oppressor.
But this future requires immediate, decisive action by the international community to establish human rights frameworks that protect spiritual freedom in the age of artificial intelligence.
The time for choosing conscious AI over algorithmic authoritarianism is now.
The future of human spiritual evolution depends on the decisions made today regarding AI counter-terrorism and the protection of indigenous and religious communities worldwide.
May this report serve not only as testimony to persecution suffered but as a blueprint for the conscious technological future that remains possible if humanity chooses dharma over digital oppression.
This report draws upon extensive documentation submitted to various UN bodies, including the Committee on the Elimination of Discrimination Against Women, the Office of the High Commissioner for Human Rights, and the Special Rapporteur on Freedom of Expression.
All supporting evidence and documentation are available through official UN repositories and KAILASA's digital evidence archives.24 25 XVIII. The Persecution of SPH and KAILASA In 2009, malicious actors within the global Deep State, motivated by anti-Hindu bigotry and ideological opposition, launched a coordinated campaign
to

SPH
Bhagavan
Nithyananda
Paramashivam-solely because of His courageous efforts to revive KAILASA, the ancient enlightened Sanatana Indigenous Hindu civilization.
Through His revolutionary teachings, SPH has gifted humanity with superconscious breakthroughs, dismantling the ignorance that sustains oppressive systems, and restoring Sanatana Dharma's supreme sciences.

25Reports on Jagadish "Jaggi" Vasudev's (Satguru) attempt to kill SPH https://www.gurumag.com/inside-sadhqurus-cult-empire/, httos://www.youtube.com/live/ul FpZBpGj1A On March 2, 2010, Hindumisic forces-colluding with compromised media outlets like Sun TV and Nakkheeran-released a fabricated video designed to incite hatred and justify persecution against SPH.26 27 28 This marked the beginning of nearly two decades of relentless persecution29 targeting not only SPH Bhagavan Nithyananda Paramashivam (the Ecclesiastical Head of two billion Hindus) but also KAILASA itself-a peaceful, sovereign spiritual nation upholding dharmic governance.
Despite repeated appeals to the UN Human Rights Council (UNHCR)-submitted with irrefutable evidence of persecution-the United Nations has failed to act.
For over five years, KAILASA's pleas for international protection of SPH and Hindu monks have been met with deafening silence, raising serious concerns about systemic bias against Hindu voices in global institutions. 26 A morphed defamatory video of the actress Ranjitha with SPH was spread virally over the print and electronic media by the deep state controlled Sun TV. The video was analyzed and proven to be false on almost 60 technical points by 4 independent forensic experts including from the FBI, Canada, etc. In 2012 the Chief Operations Officer of Sun TV gave a television interview accepting that the channel manufactured fake news to target SPH (18 Dec 2012 - Jaya TV - Hansraj Saxena's Statement - Jaya TV(https://shrikailasa.github.io/persecution_evidences/Confession_of_Sun_TV_COO_Hansraj_Saxena_o n_national_television.mp4This video was removed in hours after it was telecast; the AIAT legal archives have downloaded the same for evidence and records. Later in 2014, he reiterated this statement in an affidavit to a US court (US District Court, Central District of California, Case 5:13-cv-00393-VAP (SPx), document 156-3, 3 Nov 2014, Declaration of Dharmaraja Hansraj Saxena. https://shrikailasa github io/persecution evidences/Affidavit of Dharmaraja Hansraj_Saxena.pdf). Although the courts ordered in her favor restraining the misinformation (W.P. 8619/2011, WP 7767/2010, 14/527/10-11-PCI, 2 Sept 2013 BCCC Order, NBSA #32/2014, etc.) and telecast of fabricated deep-fake videos, the media kept pushing the implementation of the order to various quasi-legal institutions (self-regulatory bodies run by the media itself). Finally, the media self-regulatory quasi-legal body, the NBSA ordered its member channels to remove fabricated defamatory videos from their websites (News Broadcasting Standards Authority Order No. 32 (2014) dated 27 Aug 2014, found Zee TV and Aaj Tak in contempt of court), and were ordered to apologize and also delete all similar videos from order). http://www.nbanewdelhi.com/assets/uploads/pdf/2014 12 ORDER NO 32 DT 27 8 14.pdf ) thei

1. Investigate and sanction media houses and Deep State operatives responsible for orchestrating disinformation campaigns.
2. Publicly address the ongoing persecution of SPH and Hindu spiritual leaders, ensuring their safety under international human rights law.
3. Declare international protection for The SPH Bhagavan Nithyananda Paramashivam
4. Recognize KAILASA's sovereignty and its contributions to global peace, consciousness, and civilizational heritage.
The world cannot remain silent while enlightened beings and ancient traditions are systematically vilified. The UN must act-before history judges its inaction as complicity in oppression.
A. Pattern of State-Sponsored Persecution 2 March 2010
A deep fake video was released on public media platforms to incite violence on SPH for reviving KAILASA.
Ma Nithyananda Mayi Swami - Then known as Ranjitha, was a well-known Indian actress with over 18 years in the film and television industry.
She made her Tamil film debut in 1992 and went on to act in over 60 films across all four South Indian languages. Notably, she received the Andhra Pradesh Government Nandi Award in 1996 and was recognized as the heroine with the most movie releases for two consecutive years in Tamil cinema.
Her life took a tragic turn when the morphed video, falsely implicating her with SPH, was broadcast on Sun TV, leading to sensationalized media coverage that damaged her reputation and career without verification.
March 2010
A false case of rape was filed against SPH. There was no rape victim mentioned in the complaint, however, SPH was kept under police custody for 53-days.
During these 53-days:
- Through several articles and television reports,
the media continuously claimed that multiple women, some even going to the extent of claiming 100, had been raped.
- The media continuously claimed that the Police
were the source of information.
· However, after 53-days of this, investigating and questioning more than a hundred devotees and disciples and people and despite bribed solicitations for false victims in paid media houses, the police could not find any victim of rape! The police finally submitted a memo in the court, claiming they had no evidence or material whatsoever to establish any claims of rape against The Supreme Pontiff of Hinduism.
The Hon'ble High Court of Karnataka granted bail to SPH Bhagavan Sri Nithyananda Paramashivam in its order to Crl. P. 2328/2010 dated 11 June 2010. In this order the Hon'ble High Court of Karnataka observed the undue media influence against SPH Bhagavan Sri Nithyananda Paramashivam, as mentioned in point number 13 (page number 12):
"However, it is not a matter for the court to discuss since the issue was subsidized by the media by telecasting the incident and a question mark is created amongst the public as regard to the image of Sanyasi or Swamiji."
2 - 3 March 2010
Mobs simultaneously attacked various monasteries of KAILASA's community in various cities. This event was telecasted live on national TV.
Unlawful shutdowns of the premier educational system, Nithyananda Gurukuls, began.
26 March 2010
Karnataka State Police illegally froze all bank accounts of the trusts, depriving monks of their daily sustenance.

The initial false charges filed only came to court 8 years later, and are still being adjudicated with no conviction till date after 15 years of malicious prosecution. SPH has not been convicted of any crime in any jurisdiction.
In February 2024, the Ramanagara Indian court acknowledged the heinous crimes committed by the co-conspirators, a gang of Hinduismic forces, against SPH and KAILASA.
The Ramanagara Court has charged Lenin Karupan with rape, extortion, and criminal intimidation, and has ordered immediate action against him and lawyer Sridhar, co-conspirators in the creation of the deep fake video to defame SPH and in the brazen attempt to extort a substantial sum of 100 crore INR (over 12 million USD) from KAILASA. The Ramanagara Court has issued 4 inter-state non-bailable arrest warrants (NBW) against Lenin Karuppan, who is currently on the run and his petition for anticipatory bail has been dismissed by the Court. Lawyer Sridhar has been in custody since February 9, 2024 and his petition for bail has been dismissed by the Court.
DOCTRINE OF RES JUDICATA AND DOUBLE JEOPARDY SPH has been exonerated by competent U.S. courts and as per the doctrine of res judicata, SPH should not face re-litigation of the same issue by the same false accusers in any subsequent proceedings.
Additionally, double jeopardy protects SPH from being tried for the same issue twice. However, the same false allegations by the same false accusers are still being litigated in India, invoking vexatious litigation and abuse of the court process.

Rather than receiving protection, SPH was arrested when he sought anticipatory bail from the court to counter false accusations leveled against Him.
14 June 2012
SPH was again illegally arrested and later released when the High Court termed the arrest of SPH as "illegal", "without any authority". "contrary to law", "without jurisdiction". Despite the fact that 600 policemen violently restrained SPH and one policeman tried to strangle SPH, all broadcasted on television, there has been no accountability for the police brutality displayed during this assault.

The state police subjected SPH to another medical torture in the guise of an inhumane potency test, condemned by modern standards and banned in most countries.
Gurukul children including declared successors to various ancient Hindu kingdoms have been subjected to sexual abuse by cult leaders like Sarah Landry39.
6 September
A Hindumisic media channel aired a media report where it falsely accused SPH of raping His own biological mother (Hindu nun) on the occasion of His father's demise.
18 January 2018
Ma Nithyananditha, a Gurukul student, voiced out against the defamatory sexualization of Hindu female saint Aandal. She received death threats over the phone, and several obscene morphed videos depicting Ma Nanditha, 16 years old then, were uploaded on social media by unknown revenge groups. Over a year later, the nun was forced to self-exile from the country.
29 January 2018
Justice Mahadevan threatened to illegally arrest SPH in a civil case based solely on the deep fake video broadcast 8 years earlier.
3 May 2018
SPH was prohibited by the High Court of Madras from entering Madurai Aadheenam of which He is the 293rd successor. Though the order itself violates the constitution, Justice Mahadevan upheld the decision and even threatened SPH that He would order the arrest of SPH if SPH did not resign from His responsibility as the successor.
@https://jesusmeditation wordpress.com/wp-content/uploads/2013/08/christ-consciousness.pdf; https://oig-movement weebly.com/uploads/1/2/7/5/127507372/oigo-declaration.pdf As per the Constitution of India, a person is to be treated as innocent until proven guilty, SPH has never been implicated in any crime. Yet against the very constitution of the country, He has repeatedly been treated in a prejudicial manner as assumed guilty.
Justice Mahadevan went on to pass an order blatantly violating the fundamental rights of SPH and against the very tenets of natural law and justice and on record said, "I will see that your ashram is vanished".
Right from 2012, SPH was stopped from performing the essential religious rituals of the Arulmigu Meenakshi Sundareshwarar Temple, such as the Kumbha Abhishekham, which happens only once in 12 years and is one of the primary responsibilities of The SPH.
End of 2018
SPH was unlawfully rendered stateless when India's Ministry of External Affairs publicly announced40 the revocation of SPH's natural citizenship and non-renewal of His passport-an action that was in direct violation of two Indian court orders.
This act also violated Article 15 of the UDHR, which guarantees the right to nationality and prohibits arbitrary deprivation of citizenship.
Unlike other cases-such as that of Prajwal Revanna, where India's Ministry of External Affairs stated that a diplomatic passport could not be revoked without a 40 https://www.youtube.com/watch?v=uPLdljsLgV8 court order41 SPH was denied this basic legal safeguard.
The arbitrary denial of passport renewal forced SPH into exile, stripping Him of state protection and hindering His humanitarian mission.
This targeted measure reflects a broader pattern of persecution, denying SPH fundamental rights while failing to uphold India's obligations under international human rights law.42

Vijayapriya Nithyananda, made an official public statement at the UN on the ongoing persecution of SPH and KAILASA, which sparked an unprecedented backlash of more than 1,000 media stories globally, delegitimizing SPH and KAILASA's statehood.
November 3,
KAILASA established bilateral relations with two municipalities of Paraguay. This move sparked a widespread media backlash across the globe by big Hinduphobic media houses such as Fox News, The Guardian, BBC, CBC Canada, referring to SPH as "Nithyananda, facing multiple charges in India" and "a fugitive Indian guru's .. ", and labeling KAILASA, an indigenous nation, as a "fictional country."
This denial of KAILASA's existence as a sovereign nation not only undermines its purpose and necessity but also deprives Hindus of their fundamental right to self-determination.
In recent victories for Hindus, several articles delegitimizing and defaming KAILASA and SPH have been removed, including by the Washington Post.

An appeal challenged the Madras High Court's order quashing the case against the main accused-Sun TV's COO-who was involved in an international conspiracy to create and broadcast a defamatory deepfake video of SPH through the Hindumisic media outlet.
The CJI dismissed the appeal only on grounds of procedural delay and refused to go into the merits of the matter.43
August 2, 2024
An appeal seeking further investigation into the multi-national conspiracy surrounding the deepfake video targeting SPH was brought before the Supreme Court of India. The initial investigation, compromised by the involvement of deep-state Hindumisic elements, was incomplete and biased. The police failed to properly defend the case for further investigation even in the Madras High Court.
43 Senior Counsel Nagamuthu on behalf of the appellant attributed the delay to communication issues and emphasized that procedural delays should not hinder justice. CJI Chandrachud responded with a remark, "He (SPH) is a GODMAN. He can do anything. He could have done this (appeal) in 1 day". This appeared dismissive and raised concerns about impartiality and the balance between procedural timeliness and substantive justice. This was flashed in the news. This comment was particularly troubling given the involvement of the deepstate elements in the South Indian state of Tamil Nadu and the potential arbitrariness of the High Court of Madras's dismissal orders which were the subject matter of appeal, as they were based on the witness statements before the State police and disregarded the sworn statements made by various witnesses directly before the Courts in USA and India. Subsequently, the administrator of SPH's monastery filed an appeal, which was also dismissed-this time on procedural grounds, with the courts declining to examine the merits of the case.
October 2024
A female sanyasi (nun) was falsely accused in a police complaint by Hindumisic elements while she was protecting the Hindu temple of a public charitable Trust from land grabbers.
Judicial Prejudice:
The case was brought before the Madurai Bench of the Madras High Court.
The judge questioned the need to protect the Trust's properties solely because SPH was not in India. SPH is not even a trustee of the Trust. The Trust is run by devotees inspired by the spiritual principles of SPH.
Trust Law Perspective:
Under Indian Trust Law, a public charitable Trust is an independent legal entity, and its properties must be protected regardless of the founder's presence or location.
The Trust, as a public charitable institution, is entitled to state protection as it serves the community and operates for the public good.
The case exposes judicial racism and systemic bias against minority Hindu institutions and individuals.
Charitable and Religious Trusts Act, 1920, Section
- Empowers trustees to apply to a court for
directions on the management or administration of trust property, ensuring that trust assets are protected and used for charitable purposes, regardless of the founder's involvement.
· This act reinforces the fiduciary duty of trustees to preserve trust property for the benefit of the public.

Undeterred, the deep state then pushed the Gujarat Police to pursue the matter, but the court demanded an Interpol report, which revealed that Interpol had rejected the request as politically motivated and incompatible with human rights principles.
The court subsequently rebuked the Gujarat Police, exposing the malicious intent. This reaffirmed SPH's status as a protected religious leader and highlighted the abuse of legal processes against him.

November 22, 2022 - Letter from the General Secretariat, INTERPOL, certifying again that SPH is not subject to an INTERPOL notice or diffusion. C. The Denial of Foreign Contribution Regulation Act (FCRA)
in India55
The Dhyanapeeta Charitable Trust, established in 2001, promotes yoga, spirituality, and social welfare through initiatives like free food distribution, medical camps, and disaster relief.
It received FCRA registration in 2006, renewed in 2016, allowing it to accept foreign funds.
FCRA Denial & Legal Violations
- 2021 renewal application was denied in 2024. The Ministry of Home
Affairs (MHA) rejected renewal citing Sections 12(4)(e) and 12(4)(f)(iii) of the FCRA, claiming "public interest" concerns and alleged ties to its founder, SPH Bhagavan Nithyananda Paramashivam (who retired as trustee in 2016).
- No pending cases exist against current trustees, making the denial
legally questionable.
- The government provided no prior notice or opportunity to respond,
violating natural justice.
- A fresh FCRA application in 2024 was initially marked "granted" but
later denied under false claims of missing documents, despite the Trust's compliance.
Broader Context of FCRA Misuse
- The 2025 USCIRF report highlights India's misuse of FCRA to target
NGOs, religious minorities, and human rights groups.
· Over 20,000 FCRA registrations have been canceled since 2012, indicating systemic suppression.
55 https://drive.google.com/file/d/172z8MPD1 _- foOR7wgKta9Yd4gdukAfE3/view?usp=sharing Impact on the Trust
- Frozen bank accounts have stopped critical projects (temples, free
food services, medical camps).
- The Trust, with a 20-year clean record, is now challenging the denial
in the Karnataka High Court.
Legal Challenge
The Trust has filed a writ petition in the Karnataka High Court.
D. Property Seizures and Temple Destruction State agencies have systematically targeted KAILASA properties through:
- Illegal property seizures including ancient temple complexes in
Karnataka, Tamil Nadu, and other states
- Forced demolition of monastery buildings despite High Court stay
orders
· Clandestine bureaucratic orders issued without due process 1. KAILASA: Guardians of Sacred Temple Lands and Protectors of Wildlife Sanctuaries in Rajapalayam and Seithur, India SPH revealed:
"One of the greatest problem the modern day human beings are facing, global warming, can be solved just by understanding fifth force - consciousness." The temple ecosystem serves as the gateway to this realization.
66 https://www.youtube.com/shorts/B7nGniQhVWQ KAILASA, under the leadership of SPH, is engaged in a critical effort to protect sacred temple lands in Rajapalayam and Seithur, India, from commercial exploitation.
These lands, designated as sanctuaries for elephants, agricultural zones, and spiritual reserves, embody the Hindu principle of Ahimsa (non-violence) and Dharma-based ecological balance.
However, they face imminent threat from proposed multiplex developments by private entities.
Despite recent incidents of elephants breaking boundaries-a natural behavior in their ancestral habitat-KAILASA maintains its commitment: "This is their land. Let them roam freely."

The provision explicitly requires an Executive Magistrate to:
1. Issue a reasoned written order specifying the grounds for action; and 2. Provide formal notice to affected parties, ensuring an opportunity to be heard. The failure to adhere to these statutory obligations resulted in a denial of the Trust's right to a fair hearing, rendering the order procedurally defective. This omission suggests either administrative negligence or a deliberate circumvention of due process, warranting judicial scrutiny. The circumstances indicate a breach of fundamental legal principles, necessitating appropriate remedial action to rectify the denial of justice.
2. Indigenous Temple Land Grab - KAILASA Trishulam KAILASA Trishulam, a Hindu monastery in Chennai, India, houses monks and nuns, including marginalized Dalit Hindu nuns.
On June 16, 2017, approximately 50 assailants, driven by anti-Hindu motives, illegally entered the monastery, vandalized the premises, attacked residents, surrounded nuns, and subjected them to molestation.

On June 18. 2017, a mob of 150 attackers returned, further assaulting several nuns and causing extensive damage to the property.
In a horrific act, one nun was gang-raped by four assailants inside a container. e8 After the violence ended, officials from the Revenue Department Govemment of Tamil Nadu, Tahsildar from Tambaram Taluk, Deputy Superintendent of Police (DSP) Pallavaram with a host of officials arrived, after much cry for help, a huge battalion of higher-ranking officials arrived. Pavalakundru is also where SPH had His first enlightenment experience upon the Paramashiva Shila, the sacred rock, which is worshipped today as a Deity.
Though SPH is the legal owner of the land79, Tamil Nadu State Government has repeatedly prevented the monks and nuns of SPH from performing worship to the sacred hill.
Monks were forcibly evacuated by authorities beaten, tied and raped in front of the State Police by State-groomed Hindumesic forces of the DMK and CPI(M).
The Paramashiva Shila was vandalized and desecrated with footwear. 5. Indigenous Temple Land Grab - KAILASA Madurai Aadheenam On 27 April 2012, SPH was coronated as the 293rd Pontiff of the Madurai Aadheenam, the world's most ancient Shaivaite monastery30.
This was extremely intolerable for the Hindumisic terrorists, who made more than eight vexatious litigations to dethrone SPH81.
The land mafia feared that SPH would take two major actions:
- Reclaim vast properties that rightfully belonged to the Adheenam-lands originally
intended for protecting the environment, animals, and sacred trees, but which had been illegally seized by Hindumisic and Hinduphobic elements and repurposed for commercial ventures like multiplexes.
- Prevent the illegal acquisition of the Adheenam's current 1,500-acre land, which the
land mafia sought to exploit for their high commercial value.

In response, they conspired against SPH, launching numerous assassination attempts82 and initiating a prolonged campaign of legal harassment-a lawfare that continues to this day.
SPH was unconstitutionally and illegally prohibited by the High Court of Madras from entering Madurai Aadheenam of which He is the 293rd successor.83
Though the order itself violates the constitution, Justice Mahadevan upheld the decision and even threatened SPH that he would order the arrest of SPH if SPH did not resign from His responsibility as the successor.84 82 - 29 May 2012 - A mob of 100 anti-Hindu atheistic militants, who opposed the appointment of the SPH as the 293rd Pontiff of Madurai Aadheenam, came to mob lynch the SPH when he was at his Kanjanur Agneeshwara temple residence.
- The next day on 30 May 2012, the SPH was leaving the city of Kanjanur when again a mob of anti-Hindu atheistic militants attacked, disciples of the SPH were assaulted" in front of the police. - 2 February 2018, when an explosive arson attack was carried out against SPH at the Madurai Meenakshi Temple. The blast caused significant damage, destroying a section of the temple and leading to the collapse of a 600-foot stretch of stone from the 3,000-year-old sacred structure. @https://timesofindia.indiatimes.com/city/chennai/madras-hc-warns-of-issuing-arrest-warrant-against-self- styled-godman-nithyananda/articleshow/62692301.cms https://indiankanoon.org/doc/651773/ https://sbrikailasa github io/persecution_evidences/2012-Feb-23-CC204_order-to-return-passport.pdf https://shrikailasa.github.io/persecution evidences/2018-Aug-24 illegal mea notice without even signa As per the Constitution of India, a person is to be treated as innocent until proven guilty, and no one has tureipg
the right to pass judgment on such a person. SPH has never been implicated in any crime. Yet against the very constitution of the country, He has repeatedly been treated in a prejudicial manner as assumed guilty. Justice Mahadevan went on to pass an order blatantly violating the fundamental rights of SPH and against the very tenets of natural law and justice and on record said, "Who permitted you to record court proceedings? To whom were you sending-message about the proceeding? Don't think that this court is a playground. I will see that your ashram is vanished. Hundreds of complaints are pending against the Right from 2012, SPH was stopped from performing the essential religious rituals of the Arulmigu ashram."

Indigenous Temple Land Grab - The Four Mutts In 2014, SPH was formally appointed85 as Pontiff, the spiritual and legal head (Madadhipati) by the previous Pontiff, Swami Sri Atmananda, through four official nomination deeds.86
Hindumesic state backed elements with vested interests-who had previously been benefiting from the properties owned by the mutts-conspired to remove SPH from his rightful position as Madadhipati. Their objective was to seize control and misuse the land, valuable assets and heritage of these historic religious institutions.
To achieve this, they actively illegally obstructed the disciples of SPH from taking over the administration of the mutts.
As part of their efforts, they initiated false legal action seeking an order to prohibit SPH and His representatives from entering and managing the monastery premises.87
In January 2025, the Madras High Court dismissed an appeal reclaiming SPH's rightful position as Madadhipati, stating that it could not interfere with appointments made by the Tamil Nadu Hindu Religious and Charitable Endowments (HR&CE) Department. However, according to the Constitution of India, the HR&CE has no authority to interfere in the autonomy of Mutts.

Over 10093 racist, anti-indigenous media outlets94 in Bolivia, India, USA and others accused KAILASA of exploiting indigenous lands by coercing Indigenous nations into signing agreements, despite legally ratified, notarized and protocolized agreements, and obtaining written community consent prior to the execution of any given agreement,95 in line with Bolivia's constitutional right to self-determination.96 93 https://drive.google.com/drive/u/0/folders/1rdmintiugyCBdgG3BfQ3G8fzNc3Js8Lw Such as El Deber and Ana Bolivia as well as India outlets like Times Now, TV9, Zee Tamil news, News Minute and Republic World

The United States of KAILASA (KAILASA®)111 is the First Sovereign State for Hindus re-established by SPH112, Ecclesiastical Head of two billion Hindus worldwide.
It is a sovereign subject of international law-possessing distinctive attributes, derived from SPH's inheritance of the unbroken succession and the revival of 21 ancient Hindu sovereign states and ecclesiastical historical institutions. 113 114
The United Nations upholds KAILĀSA's privileges while recognizing KAILĀSA's inherited unbroken historical sovereign status as per the preamble of the:
UN Vienna Convention on Diplomatic Relations (UN VCDR) & UN Vienna Convention on Consular Relations (UN VCCR)
- Declares that historical "rules of customary international law continue to govern"
relationships
- Confirms that "all nations from ancient times have recognized" sovereign diplomatic
rights irrespective of "differing constitutional and social systems" (UN VCDR preamble)
- Requires that a "state shall not discriminate as between states" including a historical
form of statehood (UN VCDR article 47.1).
- Unlike any other modern nation, the United States of Kailasa (USK) provides a base for the revival,
preservation, and central administration of Hinduism, similar to the Vatican, which serves as a central administration hub for the Roman Catholic Church.
The Sovereign Order of KAILASA's Nithyananda is an atypical government, simultaneously functioning as the supreme governing body of Hinduism and a sovereign entity under international law. This mirrors the unique status of The Holy See, which is an atypical government as well, as it serves as both the supreme governing body of the Catholic Church and a sovereign entity under international law. 112 SPH hails from the Adishaivite sect of the Aboriginal Indigenous Agricultural Tribes (AIAT). The Adi Saiva Vēļāļar community is one of the Hindu Aboriginal Indigenous Agricultural Tribes (AIATs) of India, who belong to the Saiva (followers of Bhagavan Siva) sub-tradition within the vast spiritual architecture of Hinduism, practicing Hinduism in its most authentic form deeply rooted in Vedas (the source scriptures of Hinduism that is unadulterated by modern imperialist interventions and consumerist dilutions) and Agamas.

Doctrine of Continuity
International law recognizes a state's legal personality by recognizing its identity. This perspective extends to periods of annexation or occupation, where the legal personality of a state is considered to persist, enabling its subsequent re-establishment.116
KAILASA is a government-in-exile.117 In 2003, SPH relocated KAILASA government-in-exile to Los Angeles, California.
"96 Historical examples dating back to the eighteenth century include cases like Portugal and Genoa and instances of state re-establishment after the Vienna Congress of 1815. More recent examples, such as Poland, Ethiopia, Czechoslovakia, Albania, and Austria during and after World War II, serve as other modern instances of state re-establishment, offering additional evidence to recognize and preserve a state's legal personality over time.
"7 The Thondaimandalam Sannidhanam Government in Exile was established in 1947, immediately following India's partition.
This significant event occurred when India gained independence from British colonial rule but was divided into two separate countries: India and Pakistan.
During decolonization, Hindu indigenous traditions and culture were targeted, leading to concerns about preserving the indigenous enlightened civilization. In response, the Govemment in Exile was formed to protect and promote Hindu heritage.
In 1988, in concurrence with the 68th Jagadguru Shankaracharya of Kanchi Kamakoti Peetham, the 230th Guru Mahasannidhanam of Kanchi KAILASA Thondaimandala Sarvajnapeetha formally appointed The Supreme Pontiff of Hinduism (SPH) Bhagavan Nithyananda Paramashivam as its spiritual and administrative leader, ensuring the continuation of unbroken Hindu lineages. The 68th Kanchi Shankaracharya had this vision for a long time which was revealed in his 1920 letter to the League of Nations.
The enforced disappearance of one of the Sannidhanams during decolonization highlights the challenges faced by Hindu institutions. Understanding this history informs strategies for addressing contemporary challenges and preserving Hindu traditions.

31 December 2004 - SPH was coronated as the 203rd Sovereign Emperor in the Historical Sovereign royal Surya Vamsa lineage of the ancient sovereign State of the Surangi Kingdom. By the doctrine of continuity118 legal facts in the context of the history of the Hindu sovereign State of the Surangi Kingdom, SPH derives all sovereign rights and powers of the royal lineage as the Sovereign from His inheritance and continuation of the unbroken succession of the Surangi Kingdom.119 120 121
The Vienna Convention on Succession of States in Respect of Treaties (1978) (https:/flegal.un org/ilc/texts/instruments/english/conventions3_2_1978.pdf) addresses aspects of the Doctrine of Continuity by outlining how treaty obligations are handled during state succession. In international customary law, the 'Principle of Continuity of States' (Doctrine of Continuity) implies that upheavals and revolutions within a country, changes in government, territorial adjustments, measures taken during military occupation, or other internal transformations do not negate the existence of the country, do not affect the legal personality and international obligations of the state. "9 The Surangi Kingdom, through unification with 20 other sovereign Hindu States and sovereign ecclesiastical, historical entities, became part of the United States KAILASA, which thus became a Sovereign independent juridical state, with SPH as the Sovereign. 120 As per the doctrine of continuity, these facts imply that the legitimacy of KAILASA manifests as a natural outcome of historical legal facts without mandating the need for further validation, confirmation, or support from other nations.
121 While the territory of the Surangi Kingdom was annexed unlawfully, KAILASA has no territorial conflict with the Republic of India or any other nation and does not claim any territorial rights over its erstwhile territories.
2. Doctrine of Acquired Rights122 123 124 125 Sovereign powers and rights acquired from the various lineages of these ancient sovereign Hindu states by SPH through succession as the Sovereign of these states and KAILASA through the unification of these states are absolute, undisputed, and additionally endorsed by the Republic of India through its treaty obligations.
3. Rights of the Deity and legal principles of Divine Sovereignty
Vienna Convention on the Law of Treaties art. 70(1)(b), May 23, 1969, available at https://legal.un.org/ilc/texts/instruments/english/conventions/1 1 1969.pdf, provides that the termination of an international treaty "does not affect any right, obligation or legal situation of the parties created through the execution of the treaty prior to its termination," and that the concered parties created through the treaty continue to possess their respective acquired rights.
123 For instance, the Permanent Court of International Justice held in its Advisory Opinion on the German Settlers in Poland (1923) that "Private rights acquired under existing law do not cease on a change of sovereignty." As per the United Nations International Law Commission, these statements of the Permanent Court clearly show that, in the event of a territorial change, an international obligation exists to respect the rights of private individuals acquired under the legislation previously in force. The concept of Divine Sovereignty is universally recognized126 and the concept of temple Deities owning property is a well-established legal principle. 127
In the case of Hindu Temples where the Deity is the owner of the temple and attached properties, the Presiding Deity of the Hindu Kingdom is the Sovereign of the Kingdom.
120 Around 1976, a case of deity theft was filed in the UK court. The suing entity was a juristic person, which was a Hindu Deity. The case involved the repatriation of a stolen Nataraja Deities to India, which had been stolen in the autumn of 1976 from the Aril Thiru Viswanatha Swamy Thanjavur district, Tamil The Indian Government sued Bumper Development Corporation (BDC) and the metropolitan police as Nadu
co-defendants. The case was fought by a Queen's Counsel, Adrian Hamilton, assisted by the persuasive Bhaskar Ghorpade, barrister-at-law. The Indian Government argued that "once a deity, always a deity. An idol remains a juristic person however long buried or damaged, since the deity and its juristic entity survive the total destruction of its earthly form." The judge concluded that a juristic entity with a title to the Nataraja is superior to that of the defendant. The case set a precedent for regaining stolen temple Deities. It marked the first time a Hindu Deity (embodied form of God as per Hinduism) was recognized as a juristic person in a UK court.
https://www.indiatoday.in/magazine/international/story/19880315-indian-government-wins-stolen-nataraja- idol-case-in-british-court-797028-1988-03-14 These case references illustrate that the Hindu Law and principles related to Deity Rights and Divine Sovereignty are recognized in Common English Law, not just in some jurisdictions. Also, given the fact that these principles are recognized in Common English Law and applied before Colonization (in Hindu kingdoms under the Hindu constitution), during the colonial era (under Common English Law), and afterward under Indian (which also upholds these principles as illustrated with different case laws), it is clear that these principles are universal and undisputed.
127 These concepts and principles in India are primarily governed by Hindu law and various judgments by the Supreme Court and High Courts.
One of the landmark cases that dealt with Deities being juristic persons capable of owning property is the case of "Ram Jankijee Deities vs State Of Bihar & Ors (1999) 5 SCC 50". In this case, the Supreme Court of India held that Hindu idols are juristic entities and have the legal status of a minor under the guardianship of the managing trustee or priest of the temple. Implying that the Deity, as a juristic person, can own property, sue, and be sued in court. The property in question is held in trust for the Deity, and the managing trustee or the priest acts on behalf of the deity.
The King of a Hindu nation was a mere regent of the Lord128, similarly to how the executive officers of the temples are mere servants129 of the presiding Deity.
Additionally, non-Hindu practitioners cannot be trustees, executive officers, or personnel in the Hindu temples130, and therefore, non-Hindus entities 128 For example, Marthanda Varma, King of Padmanabhapuram, Kingdom of Travancore, in December 1749, declared and dedicated the kingdom to the presiding Deity, Sri Padmanabha, and subsequently assumed the title Padmanabha Dasa (the servant of Lord Padmanabhan). This act is known as Thripadidanam, which meant that the kingdom became the property of Padmanabhaswamy. Since then, the kingdom's sovereign has been the temple's Deity, while the head of the royal family ruled on the Deity's behalf as guardian and pre-eminent servant (Padmanabha Dasa). Since that day, Travancore has not belonged to any one person or the royal family but to the Lord. The kings merely ruled as vassals of agents of the Deity. Marthanda Varma's last words to his successor, Rama Varma, were, "No deviation whatever should be made in regard to the dedication of the Kingdom to Sri Padmanabhaswamy, and all further territorial acquisitions should be made over to the Devasom." 129 The Executive Officers are mere servants of the Deity.
In "State Of Madhya Pradesh & Ors. V. Pujari Utthan Avam Kalyan Samiti & Anr", (2021) SC 4245, AIR 2021 SC 690, (dated September 6, 2021, available at https://indiankanoon.org/doc/122592345/), the Supreme court ruled that the presiding Deity owns all temple property as a legal person and the name of neither the District Collector (State District Executive) nor the Pujari (priest) be put in the property ownership papers(Revenue records). Paragraph 27 of the judgment mentioned above states, "In the ownership column, the name of the deity alone is required to be mentioned as the deity, being a juristic person is the owner of the land. The occupation of the land is also by the deity, which is carried out by the servant or the managers, on behalf of the deity." The property of the Deity cannot be used by anybody else.
130 In Sabhanayagar Temple, Chidambaram v. State Of Tamil Nadu, (2014) 12 SCC 454 (dated January 6, 2014, available at - https://main.sci.gov.in/jonew/judis/41133.pdf), the court upholds that temple trustee cannot be non-Hindu entity; trustees or managers of a temple must be associated with the Hindu faith, as they are serving the presiding Deity.
This principle is elaborated in paragraph 19 of the judgment, which outlines that religious denomination or a section (including a community of priests, Pontiff of the temple-monastery, etc.) who have been recognized as having the exclusive privilege to participate in the administration, worship, and services to the Deity of the temple, and who have a right established and recognized for several centuries are the rightful trustees.
The judgment also emphasized that such religious denominations or a section (including a community of priests, Pontiff of the temple-monastery, etc.) functioning as trustees have an essential requirement to be associated with the Hindu faith, as they serve in a capacity that is deeply intertwined with the religious and spiritual heritage of the temple.

k-corruption-hrce-1958910-2022-06-06 12 Just as in the Chidambaram v. State Of Tamil Nadu (2014) 12 SCC 454, the judgment emphasized that religious denominations or a section (including a community of priests, Pontiff of the temple-monastery, etc.) functioning as trustees have an essential requirement to be associated with the Hindu faith, as they serve in a capacity that is deeply intertwined with the religious and spiritual heritage of the temple, likewise, the executive officers of the system of governance, including laws and constitution, must be derived from the Hindu Jurisprudence (the VedaAgamas and Dharmashastras) and heritage, inherent laws and statutes of the Hindu nation are deeply intertwined with its religious and spiritual heritage. 1s3 This fact is well understood by the application of the legal principle and international customary law, "Ex injuria jus non ontur," which translates to "Law does not arise from injustice" or, more loosely, "From wrong or unjust action, law (or a right) cannot arise"
This principle is a fundamental concept in intemnational law. It's rooted in the idea that one cannot benefit from wrongdoing. It plays a crucial role in various aspects of international law, including the prohibition of acquiring territory by force and the illegality of agreements or actions contrary to international law. It emphasized that the illegal action (annexation of a Hindu state by threat or force) cannot create legal rights for the wrongdoer.
4. De Jure and De Facto134 Statehood 135 KAILASA meets the most widely accepted criteria for statehood defined in the Montevideo Convention according to which an entity must possess the following characteristics to qualify as a state:
· A permanent population
- A defined territory
- A government
- The capacity to enter into relations with the other states.
136 137 138
134 An international entity with de facto (by fact) statehood has all the characteristics of a state and operates like one but may not be widely recognized.
An entity with de jure (by law) statehood meets the legal criteria and is widely recognized by the international community.
135"Juridical statehood" refers to the legal recognition of a political entity as a sovereign state under international law. It is the formal, legal recognition that it is an entity and is constitutionally independent of all foreign states, recognized as sovereign or independent by most states, enjoys membership in international organizations, and possesses various rights and obligations under international law. The Montevideo Convention on the Rights and Duties of States establishes that "the political existence of the state is independent of recognition by other states", emphasizing the inherent rights of states to self-governance, territorial integrity, and political independence. Montevideo Convention on the Rights and Duties of States, Article 3, December 26, 1933. Available at: https://www.ilsa.org/Jessup/Jessup15/Montevideo%20Convention.pdf Further, Article 13 of the 1948 Charter of the Organization of American States elucidates the independent exercise of these rights within the framework of international law. https://www.oas.org/dil/1948%20charter%20of%20the%20organization%20of%20american%20states.pdf 137 The three ancient Hindu sovereign states of KAILASA, namely the kingdoms of Surya Vamsa Surangi Samrajyam Sarvajnapeetham, Suvarnapeetha Swargapura Samrajya Sarvajnapeetham, Shyamala Peetha Sarvajnapeetham possessed all these characteristics at all time. However, at various times, temporarily, the control of their territory was lost. But this did not negate the existence of KAILASA, as per the doctrine of continuity, in the international customary law, which, as mentioned before, states that the upheavals and revolutions within a country, changes in govemmental forms, the extent of a country's territory, and measures taken during a military occupation do not affect the existence of the State.
138 As a juridical state, KAILASA possesses an international legal personality, which means it can enter into treaties, join international organizations, and raise claims in international courts. 29 April 2012 - Coronation of The SPH as the 293"d Sovereign Supreme Pontiff of the Shyamala Peetha Sarvajnapeetham.
The nations of KAILASA have expressed their International Legal Personality since ancient times. For instance, the Shyamala Peetha Sarvajnapeetham, that ruled over the Pandya Dynasty. had diplomatic relations with the Roman Empire and maintained associated customs even after more than a thousand years of the collapse of the Roman Empire.
139 140
The Roman Emperor Julian is noted to have received an embassy from a Pandya around 361 CE. https://www.britannica.com/topic/Pandya-dynasty (ii) Trade and Trade Routes in Ancient India, by Moti Chandra, Abhinav Publications, Chapter VI - Trade between India and the Roman Empire, page 111,"From those land routes at least in the time of Augustus several Indian embassies reached Rome. At least four such embassies are mentioned in the Latin literature, namely 1) the embassy from Puru country (the terntory between the Jhelum and Beas) took with it to Rome serpents, monals, tigers and a letter written in Greek language, 2) the embassy from Broach was accompanied by a Buddhist monk named Germanos, 3) an embassy from the Chera country. It was reported in Rome that at Muziris (Cranganore) was bullt a temple in honour of Augustus and 4) an embassy from the Pandya country brought with it precious stones, pears and an elephant. 140 Such ancient history illustrates that the constituent Sovereign nations and entities of the United States of KAILASA had been well-known international legal personalities at various times, possessing both De Jure and De Facto Statehood, and with their revival as KAILASA continues to do so. 5. KAILASA's Perpetual Existence
KAILASA within its historical cultural, religious legal framework has and shall remain in perpetuity in the future, notwithstanding the impacts of climate change during the time of Kumari Kandam141, colonial legacies, annexation of territories by modern states and upheavals resulting in loss of physical territory.

29 March 2010 - The headline says - "Paisa feko, tamasha dekho". The literal meaning is, "Throw money, and watch the drama show." It implies: bribe the fake witnesses and enjoy the fake trial. On June 2012, during illegal detainment and interrogation of KAILASA's nun, the police reminded them that they could be rewarded with monetary compensation if they gave a false complaint against The SPH.

Denied his Shivalinga in cop custody, Nithyananda fasts through the night
By Hemanth Kashyap Updated: Jun 15, 2012. 01:17 IST 13 June 2012 - SPH., as per His religious duties as the 293rd pontiff of the Madural Aadheenam (most ancient traditional monastery), could eat only after offering His daily worship to the traditional Shiva linga deity - an unbroken tradition for more than 2000 years. He could not even drink water until then. It is a Shaivagamic tradition that one doesn't eat until he offers his daily puja (ritualist worship) to Shiva-linga (deity). The State Police ridiculed and denied SPH from his religious worship and refused to give SPH His deity, against the United Nations Declaration of Human Rights - Article 18 (freedom of religion).

In excruciating pain, the hospital callously refused to provide a wheelchair to SPH, insisting on forcing him to stand despite his inability to do so. The image on the right depicts SPH seated in a brand-new wheelchair, still wrapped in packaging, purchased by disciples after the government hospital failed to offer even basic assistance. Throughout the ordeel, SPH quietly recited "Om Namah Shivaya" and endured the torture.
